Stat. tit. 74, § 74-4191","heading":"Child care - Contracts - Required provider qualifications","body":"- Parental responsibility.\n\nA. The Director of the Office of Management and Enterprise\n\nServices shall establish and administer child care centers with\n\nfunds available for that purpose.\n\nB. The Director of the Office of Management and Enterprise\n\nServices may approve a consortium, partnership, cooperative or\n\nagreement to provide child care centers with other public or private\n\nemployers.\n\nC. The child care centers shall be operated through a contract\n\nwith child care providers. Specifications for a contract shall be\n\ndeveloped with the assistance of, and subject to the approval of,\n\nthe Director of the Office of Management and Enterprise Services.\n\nAny such contract shall be made through the Central Purchasing\n\nDivision of the Office of Management and Enterprise Services. The\n\nlow bid will not be the single qualifier. Any child care provider\n\nshall be required to carry sufficient liability insurance coverage\n\nwhich will pay damages incurred as a result of the negligent acts or\n\nomissions of an employee of the child care provider within the scope\n\nof the employment of such person. Any child care provider shall\n\nmeet or exceed applicable state child care facilities licensure\n\nstandards.\n\nD. Nothing in this section shall prevent the Director from\n\nutilizing paragraph 13 of Section 85.5 of this title and paragraph 3\n\nof subsection A of Section 85.7 of this title to continue the\n\noperation of a child care center with emergency contracts when the\n\nservice provider's contract is canceled or terminated before another\n\nqualified service provider is procured. The employees of the Office\n\nof Management and Enterprise Services shall not be employed to\n\noperate the centers.\n\nE.
