Stat. tit. 74, § 74-5003.10b","heading":"Administration of federal funds to develop trade","body":"center and industrial park.\n\nA. 1. The Oklahoma Department of Commerce is hereby authorized\n\nto administer any federal funds received by this state that are\n\nallocated for the purposes of completion of traffic and feasibility\n\nstudies for, and the development of a trade center and industrial\n\npark by, the Continental Gateway Authority, a public trust in\n\nMcClain County, Oklahoma.\n\n2. For purposes of this section, “administer any federal funds”\n\nmeans to provide oversight administration and includes, but is not\n\nlimited to, approval or rejection by the Department of expenditures\n\nof the Authority and review by the Department of contracts proposed\n\nby the Authority for noncompliance with federal and state law,\n\nrules, regulations, and the provisions set forth herein, and the\n\nrejection by the Department of such contracts prior to their\n\nexecution by the Authority if determined by the Department to be out\n\nof compliance with law determined to be applicable by the\n\nDepartment.\n\nB. The Department of Transportation is hereby authorized and\n\ndirected to transfer to the Oklahoma Department of Commerce for use\n\nby the Continental Gateway Authority any federal funds received and\n\nallocated for the purposes set forth in subsection A of this\n\nsection.\n\nC. The Oklahoma Department of Commerce shall utilize such funds\n\nto contract with the Continental Gateway Authority for the provision\n\nof the study authorized by federal appropriation and subsection A of\n\nthis section. Such contract shall be exempt from the competitive\n\nbidding procedures set forth in Section 85.7 of Title 74 of the\n\nOklahoma Statutes and shall contain provisions as required by law.\n\nD. The Continental Gateway Authority shall utilize the funds\n\nfor the studies set out in subsection A of this section and may\n\ncontract with a consultant for such studies. Such contract shall be\n\nexempt from the competitive bidding procedures set forth in Section\n\n85.7 of the Oklahoma Statutes but shall comply with the following\n\nrequirements:\n\n1. The Continental Gateway Authority shall issue requests for\n\nproposals to no less than three and no more than five consultants to\n\nperform the studies. Detailed consideration, including interviews,\n\nshall be given to those responding to the request for proposals.\n\nThe initial screening should consider the requirements of a\n\nconsultant interview evaluation sheet as well as the following\n\nfactors to be determined from Authority staff and replies to\n\ninquiries to former clients:\n\na. specialized experience in the type of work\n\ncontemplated,\n\nb. capacity of the consultant to perform the work in the\n\nrequired time, and\n\nc. past performance;\n\n2. A full report of the evaluation procedures and\n\nrecommendations of the Authority shall be prepared by the Authority\n\nand submitted to the Oklahoma Department of Commerce for an\n\nindependent review of the entire process; and\n\n3. The Authority shall negotiate the contract with the selected\n\nconsultant, which contract shall include a fair and reasonable fee.\n\nThe negotiated scope and fee shall be reported to the Oklahoma\n\nDepartment of Commerce for review of compliance with state and\n\nfederal laws, rules and regulations. If the Authority and the first\n\nchoice consultant cannot reach an agreement, their negotiations\n\nshall be terminated and negotiations with the second-choice\n\nconsultant shall commence. If the Authority and the second-choice\n\nconsultant cannot reach an agreement, their negotiations shall be\n\nterminated and negotiations with the third-choice consultant shall\n\ncommence. If the Authority and the third-choice consultant cannot\n\nreach an agreement, then all negotiations shall be terminated.\n\nShould the Authority be unable to negotiate a satisfactory contract\n\nwith any of the three selected consultants, the Authority shall\n\nselect additional consultants in order of their competence and\n\nqualifications and shall continue negotiations in accordance with\nhall\n\ncommence. If the Authority and the third-choice consultant cannot\n\nreach an agreement, then all negotiations shall be terminated.\n\nShould the Authority be unable to negotiate a satisfactory contract\n\nwith any of the three selected consultants, the Authority shall\n\nselect additional consultants in order of their competence and\n\nqualifications and shall continue negotiations in accordance with\n\nthe provisions of this subsection until an agreement is reached.","path":["OK Code","Title 74"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os74.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"325c8de68e15c309c1f07f9d81b32b61212ad2b460b52ee895cb0d2ed9076527","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-74-74-5003.10a","next":"us-ok/okla.-stat.-tit.-74-74-5003.10d"},"notice":"GroundRules: Original legal text.
