The Governor's Council for Workforce and Economic\n\nDevelopment established under the authority of Executive Order 2005-\n\n27 is hereby recognized by the Legislature as the State's Workforce\n\nInvestment Board. The Council succeeded and was established in lieu\n\nof the Oklahoma Workforce Investment Board. Appointed members of\n\nthe Council serving under the authority of Executive Order 2005-27\n\nwhen this act becomes effective shall continue to serve until their\n\nterms have expired and their successors have been duly appointed.\n\nPursuant to the federal Workforce Innovation and Opportunity Act,\n\nthe purpose of the Council shall be to:\n\n1. Guide the development of a comprehensive and coordinated\n\nworkforce development system for the state and monitor its\n\noperation; and\n\n2. Review and make recommendations that will align the\n\nworkforce system, including education, with the economic development\n\ngoals of the state for the purpose of creating workforce and\n\neconomic development systems that are integrated and shall provide\n\nOklahoma a competitive advantage in a global economy.\n\nB. Membership of the Council shall include representatives of\n\nprivate employers who reflect Oklahoma's projected and desired\n\nbusiness and industry base and public officials from agencies which\n\nprovide programs and services related to workforce, education and\n\neconomic development. All Council members shall be in positions to\n\ninfluence policy and hiring decisions within their organizations.\n\nInitial appointments to the Council shall conform to the following\n\ndescribed schedule:\n\n1. The membership of the Council shall comply with the federal\n\nrequirements of the state investment board;\n\n2. A majority of the Council shall come from described private\n\nsector employers, including owners of businesses, chief executives\n\nor operating officers of businesses or other business executives or\n\nemployees with optimum policymaking or hiring authority, and who\n\nrepresent businesses, including small businesses, that provide\n\nemployment opportunities that, at a minimum, include high-quality,\n\nwork-relevant training and development in in-demand industry sectors\n\nor occupations in this state;\n\n3. State officials shall include incumbents or designees of the\n\nfollowing named offices, or their successors in office or function:\n\na. Governor,\n\nb. two members of the Oklahoma Senate, appointed by the\n\nPresident Pro Tempore,\n\nc. two members of the Oklahoma House of Representatives,\n\nappointed by the Speaker, and\n\nd. Executive Director of the Oklahoma Employment Security\n\nCommission;\n\n4. Additional members, at the discretion and pleasure of the\n\nGovernor, may be appointed representing the needs or interests of\n\nthe state economy or specific regional needs; and\n\n5. Ex-officio members, at the discretion and pleasure of the\n\nGovernor, may be included to provide expertise and agency\n\ninformation to the Council. These appointments may include, but not\n\nbe limited to:\n\na. the Secretary of Education,\n\nb. the Secretary of Health and Human Services,\n\nc. the Secretary of Commerce,\n\nd. the Chancellor of the Oklahoma State Regents for\n\nHigher Education,\n\ne. the Director of Career and Technology Education,\n\nf. the State Superintendent of Public Instruction,\n\ng. the Director of the State Department of Rehabilitation\n\nServices,\n\nh. the Director of the Oklahoma Department of\n\nCorrections,\n\ni. the Commissioner of the Oklahoma Department of Mental\n\nHealth and Substance Abuse Services,\n\nj. the Director of the Oklahoma Health Care Authority,\n\nand\n\nk. the Native American Liaison.\n\nC. Private sector members shall be appointed by and serve at\n\nthe pleasure of the Governor for a two-year term beginning October\n\n1, 2005, and may be reappointed. However, of the initial private\n\nsector members appointed, half shall be appointed for an initial\nMental\n\nHealth and Substance Abuse Services,\n\nj. the Director of the Oklahoma Health Care Authority,\n\nand\n\nk. the Native American Liaison.\n\nC. Private sector members shall be appointed by and serve at\n\nthe pleasure of the Governor for a two-year term beginning October\n\n1, 2005, and may be reappointed. However, of the initial private\n\nsector members appointed, half shall be appointed for an initial\n\nterm of one (1) year beginning October 1, 2005. Private members may\n\nbe removed from office for failure to attend three consecutive\n\nCouncil meetings. The chair of the Council shall be from the\n\nprivate sector and shall be appointed by and serve at the pleasure\n\nof the Governor.\n\nD. The Council shall meet at such times and places as it deems\n\nappropriate. Members shall serve without compensation. Council\n\nmembers employed by a state agency shall be reimbursed travel\n\nexpenses related to their service on the Council as authorized by\n\nstate law by their respective state agency. Legislative members of\n\nthe Council shall be reimbursed by their respective houses for\n\nnecessary travel expenses incurred in the performance of their\n\nduties as authorized by state law. Remaining Council members shall\n\nalso be reimbursed travel expenses related to their service on the\n\nCouncil by the Oklahoma Employment Security Commission as authorized\n\nby state law. No member of the Council shall profit, directly or\n\nindirectly, from any transaction with the Council.\n\nE. The duties and responsibilities of the Council in the\n\ndevelopment, monitoring and aligning of the workforce system with\n\neconomic development shall include, but not be limited to:\n\n1. Performing the duties required of the state governance board\n\nby the federal Workforce Innovation and Opportunity Act;\n\n2. Identifying the human resource investment needs of Oklahoma\n\nbusiness and industry, together with those of the citizens of the\n\nstate, so that each might respond to and meet the needs of the\n\nothers and thus together build a robust, diversified economy;\n\n3. Reviewing and evaluating workforce development programs\n\nwithin the state, formulate recommendations to increase their\n\nefficiency and effectiveness, eliminate duplication, and align with\n\neconomic goals. Recommendations shall be communicated to the\n\nGovernor, Legislature, state and federal government agencies and\n\nappropriate individuals and entities within the private sector;\n\n4. Increasing academic capability and technical skills within\n\nthe state workforce and foster lifelong learning among Oklahoma's\n\ncitizens;\n\n5. Strengthening collaboration among institutions which provide\n\neducation and training services, government agencies which\n\ncoordinate employment and other human resource investment\n\nactivities, and Oklahoma business and industry to create a seamless\n\nsystem to nurture healthy economic development; and\n\n6. Enhancing rural economic development capability and\n\ncapacity, giving particular attention to regional collaboration and\n\npartnering.\n\nF. Activities of the Council shall be coordinated by the\n\nSecretary of Workforce Development.\n\nG. The State Workforce Partners originally established under\n\nthe authority of Executive Order 2005-27 as the Workforce Solutions\n\nStaff Team is hereby recognized by the Legislature. This\n\ninteragency team shall be comprised of executive level staff from\n\nworkforce, education and economic development agencies of the state\n\nfor the purpose of providing staff support to the Council and to\n\ncreate efficiencies, eliminate duplication, and eliminate barriers\n\nto jointly providing a service delivery system. Other members may\n\nbe included on this team as the Governor may deem necessary to\n\naccomplish this goal.\n\nH. The Council shall be supported by funds available to state\n\nagencies pursuant to state and federal laws and regulations. Each\n\nmember of the Council whose agency qualifies pursuant to state and\ns, eliminate duplication, and eliminate barriers\n\nto jointly providing a service delivery system. Other members may\n\nbe included on this team as the Governor may deem necessary to\n\naccomplish this goal.\n\nH. The Council shall be supported by funds available to state\n\nagencies pursuant to state and federal laws and regulations. Each\n\nmember of the Council whose agency qualifies pursuant to state and\n\nfederal law to receive and use such funds shall assist by providing\n\nsupport and funding of the Council in carrying out the\n\nresponsibilities of the Council.\n\nI. The Council shall form a subcommittee on health workforce\n\nwhose purpose shall be to inform, coordinate, and facilitate\n\nstatewide efforts to ensure that a well-trained, adequately\n\ndistributed, and flexible health workforce is available to meet the\n\nneeds of an efficient and effective health care system in Oklahoma.\n\nDuties of the Health Workforce Subcommittee shall include, but not\n\nbe limited to, the following:\n\n1. Conducting data analysis and preparing reports on health\n\nworkforce supply and demand;\n\n2. Research and analysis of state health professional education\n\nand training capacity;\n\n3. Recommend recruitment and retention strategies for areas\n\ndetermined by the Oklahoma Primary Care Office or the Oklahoma\n\nOffice of Rural Health to be areas of high need; and\n\n4.
