There is hereby created the Work-based Learning Program.\n\nThe Governor's Council on Workforce and Economic Development shall\n\nhave authority over the program. The Governor's Council shall\n\ncoordinate the program by establishing partnerships with the State\n\nDepartment of Education, the State Regents for Higher Education, the\n\nState Department of Career and Technology Education, the Oklahoma\n\nBoard of Private Vocational Schools, the Secretary of State and\n\nbusiness entities throughout the state. The Oklahoma Employment\n\nSecurity Commission, serving as the Workforce Innovation and\n\nOpportunity Act designee as established by the Governor in Executive\n\nOrder 2023-21, shall have the official duty to develop and maintain\n\na Work-based Learning Program within its jurisdiction and will\n\ncollaborate, specifically related to registered apprenticeships,\n\nwith the Oklahoma Department of Career and Technology Education in\n\nits focus on increasing the number of registered apprenticeships and\n\ninternship programs, defined as paid and unpaid work experience by\n\nthe United States Department of Labor as contained in 20 CFR\n\n681.600, in this state to at least an aggregate of twenty thousand\n\npositions by the end of the calendar year 2020. All partners\n\nparticipating in the Work-based Learning Program shall be required\n\nto provide their expertise, time and resources as deemed necessary\n\nto advance and sustain the work-based learning goals of Oklahoma\n\nWorks to assist with publishing an annual progress report showing\n\neach state agency's steps and accomplishments toward meeting\n\nstatewide workforce goals and to network and coordinate with other\n\npublic and private entities in an effort to align all state\n\nagencies, boards and commissions and the private business sector in\n\nmeeting Oklahoma Works goals.\n\nB. The Work-based Learning Program shall include the following\n\ncomponents:\n\n1. Coordinate work-based learning opportunities through the\n\nstate's labor market and labor exchange systems to connect youth and\n\nadults in public and private sectors;\n\n2. Work toward increasing the number of youth and adults\n\nparticipating successfully in public and private work-based learning\n\nopportunities;\n\n3. Set standards for equality and fair access to quality work-\n\nbased learning experiences for all Oklahomans, including, but not\n\nlimited to, women, out-of-school youth, adults, African Americans,\n\nHispanics, Native Americans, veterans, individuals with disabilities\n\nand other target populations identified in the federal Workforce\n\nInnovation and Opportunity Act;\n\n4. Promote quality work-based learning experiences which are\n\ndevelopmentally appropriate, including an orientation for all\n\nparties, identify learning objectives for the term of the\n\nexperience, explore multiple aspects of an industry, develop\n\nworkplace skills and competencies, assess performance, provide\n\nopportunities for work-based reflection, link appropriate next steps\n\nand see that all aspects are documented and reported and comply with\n\nstate and federal labor laws;\n\n5. Convene industry partners to develop industry-specific\n\nstandards for internships in order to aid employers with the\n\ncreation of rigorous internship programs; and\n\n6. Prioritize paid work-based learning experiences to ensure\n\nequity and access.\n\nC. Each organization seeking to be a registered Work-based\n\nLearning Program in Oklahoma shall either:\n\n1. Be registered as a Work-based Learning Program, such as an\n\napprenticeship, with the United States Department of Labor; or\n\n2. File a certificate each year in the Office of the Secretary\n\nof State, which shall confirm such an organization is an active\n\nparticipant in Oklahoma's registered Work-based Learning Program.\n\nThe certificate to be filed shall include:\n\na. the name of the business, nonprofit organization or\n\ngovernment organization,\n\nb. the street address of the organization,\nted States Department of Labor; or\n\n2. File a certificate each year in the Office of the Secretary\n\nof State, which shall confirm such an organization is an active\n\nparticipant in Oklahoma's registered Work-based Learning Program.\n\nThe certificate to be filed shall include:\n\na. the name of the business, nonprofit organization or\n\ngovernment organization,\n\nb. the street address of the organization,\n\nc. the name of the primary contact for the organization,\n\nd. the electronic mail address for the primary contact of\n\nthe registered organization,\n\ne. the registered organization's North American Industry\n\nClassification System code (NAICS), if applicable,\n\nf. the number and type of work-based learning\n\nopportunities proposed for the year, the estimated\n\nterm of each opportunity, the proposed occupations,\n\nand estimated number of hours per week of each\n\nopportunity, if available,\n\ng. the number and type of work-based learning\n\nopportunities proposed for the year, the estimated\n\nterm of each opportunity, the proposed occupations,\n\nand the estimated number of hours per week of each\n\nopportunity, if available,\n\nh. signed acknowledgement of the application by the\n\nprimary contact, and\n\ni. the annual renewal shall be due on the anniversary\n\ndate of filing the registration application.\n\nThe filing shall be made electronically via the Secretary of\n\nState website.\n\nD. The annual certificate of participation shall be due on the\n\nanniversary date of original registration, as the case may be, until\n\ncancellation of the work-based organization in the Work-based\n\nLearning Program.\n\nE. The Secretary of State shall, at least sixty (60) days\n\nbefore the anniversary date each year of a participating\n\norganization, cause a notice of renewal of the annual certificate to\n\nbe sent to such organization to its last known electronic mail\n\naddress of record filed with the Secretary of State. At the time of\n\nrenewal, the organization shall provide a Work-based Learning\n\nProgram annual summary, including for each position offered:\n\n1. The number of opportunities posted;\n\n2. The number of opportunities hired;\n\n3. The type of work-based learning opportunities offered (e.g.,\n\ninternship, apprenticeship);\n\n4. The Standard Occupational Classification (SOC) code;\n\n5. The performance evaluation criteria utilized;\n\n6. The term of the position;\n\n7. The number of hours per week;\n\n8. Paid or unpaid status;\n\n9. Academic credit awarding institution, if applicable;\n\n10. Academic hours awarded, if applicable; and\n\n11. The gender, age and ethnicity of hires, if available.\n\nF. A registered organization that fails to file the annual\n\nrenewal and pay the annual renewal fee by the anniversary date of\n\nregistration shall cease to be a registered organization with the\n\nGovernor's Council for Workforce and Economic Development.\n\nG. The Secretary of State shall charge and collect the\n\nfollowing fees:\n\n1. For filing the original application, a fee of Fifty Dollars\n\n($50.00) submitted to the Secretary of State; and\n\n2. For filing subsequent annual renewals, a fee of Twenty-five\n\nDollars ($25.00) submitted to the Secretary of State.\n\nH. To coordinate with statewide career pathways efforts,\n\nregistered organizations under this program shall recruit\n\nparticipants by posting job announcements on the state labor market\n\nexchange system. Job announcements shall include the registered\n\norganization number as assigned by the Secretary of State.\n\nI. The Secretary of State shall transfer on July 1 of each\n\nfiscal year an amount based on the Governor's Council for Workforce\n\nDevelopment annual budget not to exceed Eight Hundred Fifty Thousand\n\nDollars ($850,000.00) annually from the Secretary of State revolving\n\nfund to support the administration of the program and business\n\nregistration to help enable the development of the state's talent\n\npipeline.","path":["OK Code","Title 74"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os74.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"2ba52a4024e8db5b32dd78571ebc12fe4009fa4d3ac0cf913797f202e6fc37c6","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-74-74-5003.10d","next":"us-ok/okla.-stat.-tit.-74-74-5003.10f"},"notice":"GroundRules: Original legal text.
