The Chief Executive Officer of the Oklahoma Department of\n\nCommerce shall be appointed by the Oklahoma Department of Commerce\n\nBoard created in Section 4 of this act. The Chief Executive Officer\n\nshall serve at the pleasure of the Board and shall continue to serve\n\nuntil a successor is duly appointed and qualified. The salary of\n\nthe Chief Executive Officer shall be compensated in a manner that\n\ncompares equally to similar positions in the private sector. The\n\nsalary of the Chief Executive Officer shall not be set pursuant to\n\nthe standards provided in Section 3601.2 of this title.\n\nB. The Chief Executive Officer shall be qualified for such\n\nposition by character, personality, ability, education, training and\n\nsuccessful administrative experience in the public or private\n\nsector. The Chief Executive Officer shall have experience that\n\nincludes, but is not limited to:\n\n1. Economic development program leadership;\n\n2. Business development leadership;\n\n3. Senior-level board management and leadership;\n\n4. Senior-level business and political engagement;\n\n5. Leading business development or business recruitment teams;\n\n6. Creating and implementing sector development strategies;\n\n7. Branding and marketing leadership experience; and\n\n8. Experience in recruiting companies to a state or community.\n\nC. The Chief Executive Officer shall employ such persons as are\n\nnecessary to implement the powers and duties of the Department.\n\nBecause many of the powers and duties of the Department involve\n\nworking closely with the private sector, certain employee positions\n\nof the Department shall be employed and compensated in a manner that\n\ncompares equally to similar positions in the private sector and\n\nshall be exempt from the provisions of the Civil Service and Human\n\nCapital Modernization Act. All other employees and positions shall\n\nbe subject to the provisions of the Civil Service and Human Capital\n\nModernization Act. Provided, nothing in this section shall be\n\nconstrued to limit the authority of the Legislature to specify the\n\nstatus of positions otherwise by law. Neither shall the Chief\n\nExecutive Officer have the authority to circumvent, disregard or\n\notherwise disobey specific provisions of law regarding positions in\n\nthe Department.\n\nD. The Chief Executive Officer shall serve on the board of:\n\n1. The Oklahoma Industrial Finance Authority;\n\n2. The Oklahoma Development Finance Authority; and\n\n3. The Oklahoma Ordnance Works Authority.\n\nE. The Chief Executive Officer may serve as administrator of\n\nany interlocal agreement or compact to pursue economic development\n\nand to assign any employees of the Department or employee personnel\n\nto carry out duties or obligations pursuant to any interlocal\n\nagreement or compact for economic development.\n\nF.
