The purpose of this section is to authorize the\n\nestablishment of two types of centers of excellence at institutions\n\nof higher education or nonprofit research institutions: centers of\n\nexcellence for basic research and centers of excellence for applied\n\nresearch, development and technology transfer.\n\nB. Centers of excellence for basic research will primarily\n\nundertake ongoing basic research that has potential for long-range\n\nvalue to the state's economic development. The centers should build\n\non institutional strengths and conduct activity in areas of research\n\nin which the participating institutions of higher education or\n\nnonprofit research institutions have achieved or have true promise\n\nof attaining a standard of excellence as recognized by national and\n\ninternational peers.\n\nC. Centers of excellence for applied research, development and\n\ntechnology transfer will primarily undertake applied research,\n\ndevelopment and technology transfer that has long-run potential for\n\ncommercial development. The centers should build on institutional\n\nstrengths and conduct activity in areas of research in which the\n\nparticipating institutions of higher education or nonprofit research\n\ninstitutions have achieved or have true promise of attaining a\n\nstandard of excellence in applied research and development.\n\nD. The Oklahoma Center for the Advancement of Science and\n\nTechnology (OCAST) shall award funding to centers of excellence in\n\naccordance with subsections E and F of this section.\n\nE. OCAST may award funding from the Research Support Revolving\n\nFund for new centers and increased funding for established centers\n\nonly after:\n\n1. Developing, adopting and publishing the criteria it shall\n\nuse when evaluating centers of excellence; and\n\n2. Reviewing proposals for new or established centers of\n\nexcellence containing:\n\na. documentation, in the case of applied research,\n\ndevelopment and technology transfer, that not less\n\nthan fifty percent (50%) of the center's total funding\n\nwill be provided by sources other than OCAST and other\n\nthan state-appropriated money; and, in the case of\n\nbasic research, documentation that not less than\n\ntwenty percent (20%) of the funding for centers\n\nconducting basic research will be provided by sources\n\nother than OCAST and other than state-appropriated\n\nmoney; machinery or equipment may be considered as\n\npart of the matching funds, but must be accompanied by\n\na statement that the center of excellence has received\n\nthe machinery or equipment, that it is appropriate and\n\nuseful to the program under review, and either:\n\n(1) verifying that the machinery or equipment is\n\ndonated, has only been used in testing to ensure\n\nquality control, or used by a wholesaler or\n\nretailer for demonstration purposes only and\n\nverifying the fair market value of the machinery\n\nor equipment on the date of the gift, or\nhas received\n\nthe machinery or equipment, that it is appropriate and\n\nuseful to the program under review, and either:\n\n(1) verifying that the machinery or equipment is\n\ndonated, has only been used in testing to ensure\n\nquality control, or used by a wholesaler or\n\nretailer for demonstration purposes only and\n\nverifying the fair market value of the machinery\n\nor equipment on the date of the gift, or\n\n(2) detailing the price paid by the center of\n\nexcellence, with an invoice showing the amount\n\npaid for the equipment,\n\nb. a description of the proposed center's potential\n\ncontribution to the state's economic development\n\ninterests,\n\nc. an itemized operations budget, and\n\nd. other information that may be required by the Oklahoma\n\nScience and Technology Research and Development Board.\n\nF. The board may approve proposals to establish new centers of\n\nexcellence and increase funding for existing centers contingent on\n\nthe availability of funds and only after the board finds, based upon\n\nthe proposal submitted, external peer reviews, and such additional\n\ninvestigation as the staff of OCAST shall make and incorporate in\n\nits minutes that:\n\n1. Each proposed center of excellence involves higher education\n\ninstitution(s), nonprofit research institution(s), and private\n\nenterprise;\n\n2. Each proposed center of excellence is funded at Nine Hundred\n\nThousand Dollars ($900,000.00), or so much as is needed, per year\n\nfor five (5) years, above the annual appropriation for OCAST;\n\n3. In the case of applied research, development and technology\n\ntransfer the proposed center of excellence has the potential to\n\nstimulate economic development in Oklahoma by fostering partnership\n\namong higher education institutions, nonprofit research\n\ninstitutions, and businesses;\n\n4. The center has the long-run potential to benefit existing\n\nand new businesses through innovation and development of new\n\ntechnology; and\n\n5. Approval of the proposal will not create or foster\n\nunnecessary duplication of programs, particularly at the graduate\n\nlevel of instruction.\n\nG.
