Stat. tit. 74, § 74-5060.19","heading":"Criteria for award of funding or professional service","body":"contract - Applied research proposals - Small business innovation\n\nresearch - Commercialized research.\n\nA. The Center may use monies from the Research Support\n\nRevolving Fund to carry out the purposes of this act by awarding\n\ncompetitive applied research funds, through professional service\n\ncontracts or otherwise, to institutions of higher education,\n\nnonprofit research foundations and private enterprises of special\n\nimportance to the Oklahoma economy. The Center may use the fund to\n\nprovide funding for the programs and purposes specified in\n\nsubsection D of this section.\n\nB. The board shall award funding or professional service\n\ncontracts only after:\n\n1. Developing, adopting and publishing the criteria it shall\n\nuse when evaluating research proposals; and\n\n2. Reviewing applied research proposals which present:\n\na. documentation, if the proposal is from an institution\n\nof higher education or nonprofit research\n\ninstitutions, that not less than fifty percent (50%)\n\nof the total direct cost of the proposed project will\n\nbe provided by sources other than the Center and other\n\nthan state-appropriated money; machinery or equipment\n\nmay be considered as part of the matching funds for\n\nthe research, but must be accompanied by a statement:\n\n(1) that the institution of higher education or\n\nnonprofit research institution has received the\n\nmachinery or equipment and that it is appropriate\n\nand useful to the program under review; and\n\neither\n\n(2) verifying that the equipment or machinery is\n\ndonated and has only been used in testing to\n\nensure quality control, or used by a wholesaler\n\nor retailer for demonstration purposes only and\n\nverifying the fair market value of the machinery\n\nor equipment on the date of the gift; or\n\n(3) detailing the price paid by the institution of\n\nhigher education or nonprofit research\n\ninstitution, with an invoice showing the amount\n\npaid for the machinery or equipment;\n\nb. documentation, if the proposal is from a private\n\nenterprise, that not less than fifty percent (50%) of\n\nthe total direct cost of the proposed project will be\n\nprovided by sources other than the Center and other\n\nthan state-appropriated money. No portion of the\n\nfifty percent (50%) may be provided by in-kind\n\nservices performed by the enterprise;\n\nc. a description of the potential commercial application\n\nof and the industrial sectors that will likely benefit\n\nfrom the applied research project and the potential to\n\nenhance employment opportunities in Oklahoma;\n\nd. an itemized research budget, time line and research\n\nmethodology;\n\ne. a recommendation from the sponsoring institution of\n\nhigher education, nonprofit research institution or\n\nbusiness enterprise; and\n\nf. other information that may be required by the board.\n\nC. The board may approve such applied research proposals after\n\nthe board finds, based upon the proposal submitted, external peer\n\nreview and such additional investigation as the staff of the Center\n\nshall make and incorporate in its minutes, that:\n\n1. The proposed project is research that leads to innovation,\n\nnew knowledge or technology and is not training or technical\n\nassistance for business firms;\n\n2. The project has a reasonable probability to enhance\n\nemployment opportunities within Oklahoma; and\n\n3. The project is technically sound and will produce a\n\nmeasurable result.\n\nD. The Center is directed to develop a small business\n\ninnovation research (SBIR) matching support program which meets the\n\nhighest current standards for state matching support to federal SBIR\n\nprogram grants. The Center shall also develop and implement a\n\nprogram to financially support the preparation of SBIR grant\n\nproposals by Oklahoma entities. The Center may also develop and\n\nimplement programs to encourage Oklahoma firms to participate in\n\nother federal research and development programs including, but not\nts the\n\nhighest current standards for state matching support to federal SBIR\n\nprogram grants. The Center shall also develop and implement a\n\nprogram to financially support the preparation of SBIR grant\n\nproposals by Oklahoma entities. The Center may also develop and\n\nimplement programs to encourage Oklahoma firms to participate in\n\nother federal research and development programs including, but not\n\nlimited to, the Small Business Technology Transfer (SBTT) program.\n\nE.
