Stat. tit. 74, § 74-5060.4","heading":"Definitions","body":"As used in the Oklahoma Science and Technology Research and\n\nDevelopment Act:\n\n1. \"COEAT\" means Center of Excellence for Aerospace Technology,\n\nan initiative within the Oklahoma Aerospace Institute that\n\nundertakes applied research, development and technology transfer\n\nthat has long-term potential for commercial development;\n\n2. \"CASQ\" means Center of Aerospace Supplier Quality, an\n\ninitiative within the Oklahoma Aerospace Institute that serves as a\n\nconduit between Oklahoma's military installations and the aerospace\n\nindustry;\n\n3. \"Applied research\" means those research activities occurring\n\nat institutions of higher education, nonprofit research foundations,\n\nand in private enterprises which have potential commercial\n\napplication;\n\n4. \"Basic research\" means any original investigation for the\n\nadvancement of scientific knowledge not having a specific commercial\n\nobjective, but having potential long-range value to commercial\n\ninterests;\n\n5. \"Board\" means the Oklahoma Science and Technology Research\n\nand Development Board;\n\n6. \"Center\" or \"OCAST\" means the Oklahoma Center for the\n\nAdvancement of Science and Technology;\n\n7. \"Commercialization Center\" means a private, nonprofit\n\ncorporation contracting with and funded in part by OCAST to:\n\na. attract to, and retain in, Oklahoma technology and\n\ntechnology-based enterprises,\n\nb. promote and assist with the development and expansion\n\nof scientific and technology-based industry in the\n\nstate,\n\nc. facilitate the development of incubators for\n\ntechnology-oriented enterprises,\n\nd. assist technology-based enterprises in developing and\n\nexpanding their businesses, obtaining financing and\n\nfunding, attracting capital, including seed capital\n\nand venture capital, and attracting and retaining key\n\nmanagement personnel, scientists, and skilled labor,\n\nand\n\ne. develop, operate, and manage programs to facilitate\n\nentrepreneurial activity with respect to technology,\n\nscientific-based, biomedical, biomedical-technical,\n\nand technology-oriented enterprises in this state;\n\n8. \"Enterprise\" means a firm with its principal place of\n\nbusiness in Oklahoma;\n\n9. \"Health research project\" means a specific examination,\n\nexperimentation or investigation, or initiative to provide research\n\nresources oriented principally toward basic, applied, and\n\ndevelopmental scientific inquiry related to the causes, diagnosis,\n\nprevention, and treatment of human diseases and disabilities and\n\nmental health and emotional disorders, and the rehabilitation of\n\npersons afflicted with such diseases, disabilities, and disorders;\n\nnew knowledge, better understanding, and innovative methods to\n\nimprove the processes by which health care services are made\n\navailable and how they may be provided more efficiently, more\n\neffectively and at a lower cost, for all the citizens of this state;\n\nand the development of new products and services which shall form\n\nthe basis of new high-technology health research and care industry\n\nfor this state;\n\n10. \"Industrial Extension System\" means a coordinated network\n\nof public and private manufacturing modernization resources, the\n\npurpose of which is to stimulate the competitiveness of Oklahoma\n\nsmall and medium-sized manufacturing firms;\n\n11. \"Institutional Review Board\" means a committee composed of\n\ninvestigators, lay representatives, and legal counsel, which is\n\nestablished at each institution of higher learning and each\n\nnonprofit research institution receiving funds from a health\n\nresearch project, for the express purpose of determining the\n\nappropriateness of any research involving human subjects;\n\n12. \"Institutions of higher education\" means public and private\n\ncolleges and universities in the state;\n\n13. \"Investigator\" means a person who proposes research\n\nprojects and is primarily responsible for the execution of the\nt research institution receiving funds from a health\n\nresearch project, for the express purpose of determining the\n\nappropriateness of any research involving human subjects;\n\n12. \"Institutions of higher education\" means public and private\n\ncolleges and universities in the state;\n\n13. \"Investigator\" means a person who proposes research\n\nprojects and is primarily responsible for the execution of the\n\nproposed projects and is employed by or affiliated with an\n\ninstitution of higher education, a nonprofit research institution in\n\nthis state, or a private enterprise;\n\n14. \"Nanotechnology\" means technology development at the\n\nmolecular range (1nm to 100nm) to create and use structures,\n\ndevices, and systems that have novel properties because of their\n\nsmall size;\n\n15. \"New technology\" means methods, products, processes and\n\nprocedures developed through science or research;\n\n16. \"Nonprofit research institution\" means any not-for-profit\n\npublic or private facility in this state which has the capabilities\n\nfor research projects and which is not a subsidiary of any\n\ncorporation, partnership, or association organized for profit, nor\n\nis its stock or assets owned or controlled by a corporation,\n\npartnership, or association organized for profit;\n\n17. \"OAI\" means Oklahoma Aerospace Institute, a strategic\n\npartnership that will focus available resources to promote\n\ncooperation and collaboration among Oklahoma businesses,\n\nmanufacturers, military installations, commercial aviation, higher\n\neducation institutions, nonprofit research institutions, and state\n\ngovernment;\n\n18. \"OAME\" means the Oklahoma Alliance for Manufacturing\n\nExcellence, Inc., a corporation to be formed pursuant to the\n\nprovisions of Title 18 of the Oklahoma Statutes and Section 5060.26\n\nof this title;\n\n19. \"ONAP\" means the Oklahoma Nanotechnology Applications\n\nProject;\n\n20. \"OSTRaD\" means the Oklahoma Science and Technology Research\n\nand Development Act;\n\n21. \"Person\" means any individual, partnership, corporation or\n\njoint venture carrying on business or proposing to carry on business\n\nwithin the state;\n\n22. \"Plant science research\" means those research activities\n\noccurring at institutions of higher education, nonprofit research\n\ninstitutions, and in private enterprises, which have potential\n\ncommercial application and concern plant productivity, renewable\n\nbiomass, plant-based environmental applications and chemical\n\nplatforms, plant-based solutions to improve nutrition, human and/or\n\nanimal health or performance, process applications, and seed\n\nmanagement and the development of new products and services that\n\nshall form the basis of new, high-technology plant\n\nscience/agriculture industry for this state;\n\n23. \"Product\" means any outcome, device, technique or process,\n\nwhich is or may be developed or marketed commercially and which has\n\nadvanced beyond the theoretical stage and is in a prototype or\n\npractice stage;\n\n24. \"Professional service contract\" means a written agreement\n\nproviding funds for the performance of a research project; for\n\nsalaries and fringe benefits of personnel associated with research\n\nprograms; for research equipment; for operating expenses associated\n\nwith a research program; or for services provided in connection with\n\nthe evaluation of applications submitted to the Center;\n\n25. \"Qualified security\" means any public or private financial\n\narrangement, involving any note, security, debenture, evidence of\n\nindebtedness, certificate of interest or participation in any\n\nprofit-sharing agreement, preorganization certificate or\n\nsubscription, transferable security, investment contract,\n\ncertificate of deposit for a security, certificate of interest or\n\nparticipation in a patent or application therefor, or in royalty or\n\nother payments under such a patent or application, or, in general,\n\nany interest or instrument commonly known as a \"security\" or any\npation in any\n\nprofit-sharing agreement, preorganization certificate or\n\nsubscription, transferable security, investment contract,\n\ncertificate of deposit for a security, certificate of interest or\n\nparticipation in a patent or application therefor, or in royalty or\n\nother payments under such a patent or application, or, in general,\n\nany interest or instrument commonly known as a \"security\" or any\n\ncertificate for, receipt for, guarantee of, or option, warrant or\n\nright to subscribe to or purchase any of the foregoing to the extent\n\nallowed by law;\n\n26. \"Seed-capital\" means funding, capital, and financing that\n\nis provided and made available for the creation, development,\n\nvalidation, refinement, protection, manufacturing, marketing, and\n\ncommercialization of a product, process, concept, invention, or\n\ninnovation, whether for the startup of a new enterprise or for the\n\nexpansion, growth, or restructuring of an existing enterprise; and\n\n27. \"Technology transfer\" means a two-way process by which\n\nideas or inventions for processes or products (developed in research\n\nprograms usually on a laboratory or pilot-plant scale) are converted\n\nto commercial use.","path":["OK Code","Title
