Stat. tit. 74, § 74-5062.5","heading":"Definitions","body":"As used in the Oklahoma Development Finance Authority Act:\n\n1. \"Authority\" means the Oklahoma Development Finance\n\nAuthority;\n\n2. \"Agricultural enterprise\" means facilities for farms,\n\nranches, other agricultural, silvicultural or aquacultural commodity\n\noperations, and related businesses and industries, including but not\n\nlimited to, grain elevators, shipping heads, livestock pens,\n\nwarehouses and other storage facilities, related transportation\n\nfacilities, drainage facilities and any related facilities hereto;\n\n3. \"Board of directors\" means and includes the board of\n\ndirectors of the Authority created by this act;\n\n4. \"Bonds\" means any bonds, notes, obligations, debentures,\n\ninterim certificates, grant and revenue anticipation notes, interest\n\nin a lease, lease certificates of participation or other evidences\n\nof indebtedness, whether or not the interest on which is includable\n\nin the gross income of the recipients thereof for federal income tax\n\npurposes, issued by the Authority pursuant to this act;\n\n5. \"Educational facilities\" means any facility intended by an\n\neducational institution in furtherance of its educational program,\n\nincluding, but not limited to, classrooms, laboratories,\n\nadministrative buildings, equipment and other property for use\n\ntherein or thereon;\n\n6. \"Energy conservation facilities\" means any facility\n\ndesignated for the purchasing and installation of energy\n\nconservation equipment or facilities, including building\n\nmodifications;\n\n7. \"Energy distribution facilities\" means an energy\n\ndistribution system owned, in whole or in part, by an individual,\n\nmunicipality, corporation or other governmental or business entity\n\nand which uses alcohol, peat, solar, waste, water and related dams,\n\nwind, wood, coal or natural gas;\n\n8. \"Energy generating facilities\" means (a) for a system which\n\ndoes not generate electricity, an energy generating system owned, in\n\nwhole or in part, by an individual, municipality, corporation or\n\nother governmental or business entity, and which systems uses\n\nbiomass, peat, solar, waste, water and related dams, wind, wood or\n\ncoal, or which is an energy conservation project; or (b) for a\n\nsystem which does generate electricity, an energy generating system\n\nwhich uses alcohol, peat, solar, waste, water and related dams,\n\nwind, wood or coal, and which is owned, in whole or in part, by an\n\nindividual, municipality, corporation or other business or\n\ngovernmental entity;\n\n9. \"Facilities\" means any real property, including, without\n\nlimitation, any land, building, fixture, improvement, easement,\n\nright-of-way, water right, land lying under the water or air right,\n\nand any personal property, including without limitation any\n\nleasehold, inventory, account receivable, patent, license,\n\nfranchise, machinery, equipment, merchandise, raw material, supply,\n\nproduct, work in process or stock in trade, or mixed property of any\n\nand every kind including, but not limited to, buildings, rights-of-\n\nway, roads, streets, waterways, transportation systems, ports and\n\nterminals, pipes, pipelines, reservoirs, utilities, pollution\n\ncontrol systems, toxic and solid waste disposal systems, health care\n\nfacilities for furnishing any physical or mental health care,\n\nmaterials, commodities, equipment, fixtures, machinery, furniture,\n\nfurnishings, instrumentalities, tourism facilities in the form of\n\namusement parks, entertainment parks, theme parks, or museums, and\n\nother real, personal or mixed property of every kind or any\n\npreliminary studies and surveys related thereto;\n\n10. \"Financing assistance\" or \"financial assistance\" means the\n\nmaking of, entering into or providing for guarantees, leases,\n\ninsurance, financing credits, loans, letters of credit, financing\n\nassistance payments, grants or other financial aid;\n\n11. \"Financial document\" means a lease, installment sale\nstudies and surveys related thereto;\n\n10. \"Financing assistance\" or \"financial assistance\" means the\n\nmaking of, entering into or providing for guarantees, leases,\n\ninsurance, financing credits, loans, letters of credit, financing\n\nassistance payments, grants or other financial aid;\n\n11. \"Financial document\" means a lease, installment sale\n\nagreement, conditional sale agreement, note, mortgage, chattel\n\nmortgage, loan agreement or other instrument pertaining to an\n\nextension of financial assistance;\n\n12. \"Industrial enterprise\" means facilities for manufacturing,\n\nproducing, research, processing, assembling, repairing, extracting,\n\nwarehousing and distributing goods, facilities for any service\n\nprofession, facilities for communications, computer services,\n\ntransportation and corporate and management offices and services\n\nprovided in connection with any of the foregoing, in isolation or in\n\nany combination that involve the creation of new or additional\n\nemployment or the retention of existing employment, and industrial\n\nparks;\n\n13. \"Operating capital\" means start-up costs of general\n\nadministration for a temporary period not to exceed one (1) year for\n\nqualified enterprises as defined in the bylaws or by resolution of\n\nthe Authority;\n\n14. \"Political subdivision\" means any incorporated city or\n\ntown, school district, county, special district or public trust\n\nwhere a city, town, school district, county or special district is a\n\nbeneficiary and all their institutions, agencies or\n\ninstrumentalities;\n\n15. \"Pollution\" means any form of environmental pollution,\n\nincluding, but not limited to, water pollution, air pollution,\n\nradiation contamination, noise pollution or pollution caused by\n\nsolid waste disposal;\n\n16. \"Pollution control facilities\" means any facilities for the\n\npurpose of reducing, abating, preventing. controlling, or\n\neliminating pollution caused or produced by the operation of any\n\nmanufacturing, industrial, or commercial enterprise or any utility\n\nplant or useful for the purpose of removing or treating any\n\nsubstance in processed material, which material would cause\n\npollution if used without such removal or treatment;\n\n17. \"Project\" means any facility used for or in connection with\n\nany of the following: industrial enterprises, agricultural\n\nenterprises, capital improvements, health-care facilities,\n\neducational facilities, pollution control facilities, energy\n\nconservation facilities, energy distribution facilities, energy\n\ngenerating facilities, recreational facilities, tourism facilities\n\nin the form of amusement parks, entertainment parks, theme parks, or\n\nmuseums, short-term advance funding, waste water facilities;\n\n18. \"Short-term advance funding\" shall mean the financing of\n\ntemporary cash shortfalls of the state or political subdivisions;\n\n19. \"State\" means the State of Oklahoma or any office,\n\ndepartment, agency, authority, commission, board, institution,\n\nhospital, college, university, public trust where the state is the\n\nbeneficiary or other instrumentality thereof;\n\n20. \"Waste water\" shall mean any water containing sewage,\n\nindustrial wastes, or other wastes or contaminants derived from the\n\nprior use of such water, and shall include, without limiting the\n\ngenerality of the foregoing, surface water of the type storm sewers\n\nare designed to collect and dispose of; and\n\n21. \"Waste water facilities\" shall mean any facility for the\n\npurpose of treating, neutralizing, disposing of, stabilizing,\n\ncooling, segregating or holding waste water, including, without\n\nlimiting the generality of the foregoing, facilities for the\n\ntreatment and disposal of sewage, industrial wastes, or other\n\nwastes, waste water, and the residue thereof; facilities for the\n\ntemporary or permanent impoundment of waste water, both surface and\n\nunderground; and sanitary sewers or other collection systems,\nstabilizing,\n\ncooling, segregating or holding waste water, including, without\n\nlimiting the generality of the foregoing, facilities for the\n\ntreatment and disposal of sewage, industrial wastes, or other\n\nwastes, waste water, and the residue thereof; facilities for the\n\ntemporary or permanent impoundment of waste water, both surface and\n\nunderground; and sanitary sewers or other collection systems,\n\nwhether on the surface or underground, designed to transport waste\n\nwater together with the equipment and furnishings thereof and their\n\nappurtenances and systems, whether on the surface or underground\n\nincluding force mains and pumping facilities therefor.","path":["OK
