Any company or association proposing to qualify as a sponsor\n\nunder this act shall file an application with the Director of the\n\nOklahoma Department of Commerce for approval. The application shall\n\ncontain such information as the Director may by regulation require,\n\nand shall specifically acknowledge applicant's agreement to be bound\n\nby the conditions set forth in rules and regulations issued pursuant\n\nto this section. Each applicant also shall demonstrate:\n\n1. That a facility exists that can be transformed into an\n\nincubator at a specified cost;\n\n2. The ability directly to provide, or arrange for the\n\nprovision of, business development services for tenants of the\n\nincubator. These services shall include, but not be limited to,\n\nfinancial consulting assistance, management and marketing\n\nassistance, and physical services;\n\n3. A potential for sustained use of the incubator facility by\n\neligible tenants, through a market study and other means; and\n\n4. The ability to manage and operate the incubator facility in\n\naccordance with Section 7 of this act.\n\nB. In determining whether to approve an application for\n\nqualification as a sponsor, the Director shall consider:\n\n1. The ability of the sponsor to carry out the provisions of\n\nSection 7 of this act;\n\n2. The economic impact of the incubator on the community;\n\n3. The incubator's conformance with state, areawide and local\n\neconomic development plans if such exist; and\n\n4.
