Stat. tit. 74, § 74-5091","heading":"Oklahoma Research and Development Rebate Fund — Qualified","body":"research expenditures — Eligibility.\n\nA. “Qualified research expenditures” means the amount of\n\nqualified research expenses claimed on line 9 or line 28 of federal\n\nForm 6765 (Rev. December 2023) or the relevant line number of\n\nfederal Form 6765 in effect for the applicable tax year for expenses\n\nincurred in this state.\n\nB. There is hereby created in the State Treasury a revolving\n\nfund for the Oklahoma Department of Commerce to be designated the\n\n“Oklahoma Research and Development Rebate Fund”. The fund shall be\n\na continuing fund, not subject to fiscal year limitations, and shall\n\nconsist of all monies appropriated to the Department that are\n\ndesignated for deposit in the fund. Monies appropriated to this\n\nfund shall be expended to reimburse qualifying establishments for\n\nqualified research expenditures.\n\nC. There is hereby created a research and development rebate\n\nprogram for the cost of qualified research expenditures by\n\nestablishments.\n\nD. The investment rebate program shall be administered by the\n\nOklahoma Department of Commerce.\n\nE. To be eligible for consideration for a research and\n\ndevelopment rebate payment awarded under the provisions of this act,\n\nthe establishment shall:\n\n1. Submit an application and documentation to the Department,\n\nas required by the Department;\n\n2. Provide documentation as required by the Department to\n\ndetermine that the research and development expenditures occurred\n\nwithin this state; and\n\n3. Have filed all Oklahoma tax returns as required by law.\n\nF. Claims for rebate approved by the Department shall be equal\n\nto five percent (5%) of qualified research expenditures of the\n\nestablishment.\n\nG. Claims for rebate approved by the Department shall be paid\n\nin the order that they are received. Total claims approved for\n\nrebate shall not exceed the balance of the Oklahoma Research and\n\nDevelopment Rebate Fund. In no event shall claims approved for\n\nrebate exceed Twenty Million Dollars ($20,000,000.00) in any fiscal\n\nyear.\n\nH. If the amount of a claim exceeds the amount available in the\n\nOklahoma Research and Development Rebate Fund or the fiscal year\n\nlimitation provided in subsection G of this section, the payment may\n\nbe made in a prorated amount. Claims for rebate not approved by the\n\nDepartment due to the limitations provided in subsection G of this\n\nsection may be approved and paid in subsequent fiscal years.\n\nI.
