There is hereby created within the Department of Public\n\nSafety, the Office of Homeland Security. The Commissioner of Public\n\nSafety shall be the Homeland Security Advisor and shall possess or\n\nobtain federally recognized clearances as appropriate to perform the\n\nduties of the position. The Commissioner of Public Safety, as\n\nHomeland Security Advisor, shall be responsible for the operation\n\nand administration of the Office. The Commissioner shall appoint\n\nsubordinates and employees and may make such expenditures with\n\nappropriated funds, or from such other available funds as may be\n\nnecessary to carry out the purposes of the Oklahoma Homeland\n\nSecurity Act and other programs specified by law.\n\nB. The Commissioner may commission any employees appointed to\n\nthe Office as peace officers. Any member of the Office who receives\n\na commission pursuant to the provisions of this subsection shall\n\nexercise the powers and authority of an officer of the Department of\n\nPublic Safety, as provided for in Section 2-117 of Title 47 of the\n\nOklahoma Statutes, provided such commissions shall be subject to all\n\nrequirements set forth by the Commissioner, and the Commissioner may\n\nset forth any limitations on the power and scope of the commission.\n\nAll commissioned staff must obtain and maintain certification as\n\nfull-time peace officers in accordance with the provisions of\n\nSection 3311 of Title 70 of the Oklahoma Statutes.\n\nC. The Office of Homeland Security shall consist of at least\n\nthree functions:\n\n1. Prevention and Intelligence;\n\n2. Response and Recovery Planning; and\n\n3. Awareness and Preparedness.\n\nD. Other federal, state, and local personnel may be assigned to\n\nthe Office of Homeland Security pursuant to an interagency\n\nagreement. All positions and personnel of the Office of Homeland\n\nSecurity shall be exempt from the full-time employee limit of the\n\nDepartment of Public Safety.\n\nE. The Office of Homeland Security shall have the duty and\n\nresponsibility to develop and coordinate the implementation and\n\nadministration of a comprehensive statewide strategy that is\n\nintegrated into the emergency operations plan to secure this state\n\nfrom the results of acts of terrorism, from a public health\n\nemergency, from cyberterrorism, and from weapons of mass destruction\n\nas that term is defined in 18 U.S.C., Section 2332a, and to perform\n\nother duties assigned by the Commissioner. These duties shall\n\ninclude but not be limited to:\n\n1. Representing this state with federal agencies as the state\n\nHomeland Security Advisor for purposes of accessing federal funds\n\nand cooperating with federal agencies in the development and\n\nimplementation of a nationwide homeland security plan of response;\n\nand\n\n2. Coordinating the Homeland Security efforts within this state\n\nincluding working with the Governor and Legislature, state agencies,\n\nand local elected officials and local governments, emergency\n\nresponder groups, private-sector businesses, educational\n\ninstitutions, volunteer organizations, and the general public.\n\nState agencies receiving federal funding for homeland security\n\npurposes shall report the amount and intended use of those funds to\n\nthe Office of Homeland Security to ensure efficient use of funds and\n\nto avoid duplication of efforts.\n\nF. Included in the comprehensive statewide strategy and\n\nconsistent with the National Strategy for Homeland Security, as\n\npromulgated by the Executive Office of the President of the United\n\nStates, or its successor plan or plans, the Office of Homeland\n\nSecurity shall establish the following strategic objectives for this\n\nstate:\n\n1. To prevent terrorist attacks;\n\n2. To reduce vulnerability to terrorism;\n\n3. To minimize the damage from and to recover from terrorist\n\nattacks; and\n\n4. Such other duties as the Governor may prescribe.\n\nG. The Office of Homeland Security shall have the following\n\nduties:\n\n1. Establish a plan for the effective implementation of a\nhall establish the following strategic objectives for this\n\nstate:\n\n1. To prevent terrorist attacks;\n\n2. To reduce vulnerability to terrorism;\n\n3. To minimize the damage from and to recover from terrorist\n\nattacks; and\n\n4. Such other duties as the Governor may prescribe.\n\nG. The Office of Homeland Security shall have the following\n\nduties:\n\n1. Establish a plan for the effective implementation of a\n\nstatewide emergency all-hazards response system including the duties\n\nand responsibilities of regional emergency response teams;\n\n2. Create, implement, and administer an advisory system;\n\n3. Coordinate and prepare applications for federal funds\n\nrelated to homeland security and accessing and distributing the\n\nfederal funds; and\n\n4. Cooperate with federal agencies in the development and\n\nimplementation of a nationwide homeland security plan or response.\n\nH. The Office of Homeland Security may enter into contracts,\n\nagreements, and memoranda of understanding with any public agency,\n\nas defined in Section 1003 of this title, for equipment and\n\npersonnel, or both, to carry out the requirements of the Oklahoma\n\nHomeland Security Act. Such agreements may include any provisions\n\nagreed upon by the parties and as required by any federal or state\n\ngrant, if applicable.\n\nI. All state agencies and political subdivisions of this state\n\nand all officers and employees of those agencies and political\n\nsubdivisions are hereby directed to cooperate with and lend\n\nassistance to the Office of Homeland Security.\n\nJ. All personnel, motor vehicles, computer and communications\n\nequipment, training equipment, records, furniture, and other\n\nproperty and equipment allocated to the Office of Homeland Security\n\nshall remain with the Office of Homeland Security upon its transfer\n\nfrom the Oklahoma Department of Emergency Management to the\n\nDepartment of Public Safety as of the effective date of this act.","path":["OK Code","Title 74"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os74.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"7e2101f997f5b9f6d424df956faa7e5a73e9cdce53d5206da6948a289c52ac69","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-74-74-51","next":"us-ok/okla.-stat.-tit.-74-74-51.1a"},"notice":"GroundRules: Original legal text.
