As used in the Oklahoma Public and Private Facilities and\n\nInfrastructure Act:\n\n1. \"Contract\" means any purchase and sale agreement, lease,\n\nservice agreement, franchise agreement, concession agreement or\n\nother written agreement entered into under the Oklahoma Public and\n\nPrivate Facilities and Infrastructure Act with respect to the\n\nprovision of a public service and any project related thereto;\n\n2. \"Improvement\" means any instruction, reconstruction,\n\nrehabilitation, renovation, installation, improvement, enlargement\n\nor extension of property or improvements to property;\n\n3. \"Partnership Committee\" means a committee consisting of nine\n\n(9) members, three members appointed by the President Pro Tempore of\n\nthe Senate, three members appointed by the Speaker of the House of\n\nRepresentatives, two representatives of the Office of Management and\n\nEnterprise Services (OMES), and a representative of the Department\n\nof Commerce, to be appointed by the Governor. Five members of the\n\nPartnership Committee shall constitute a quorum. The Partnership\n\nCommittee shall act only upon a decision of a majority of appointed\n\nmembers;\n\n4. \"Private sector entity\" means any corporation, whether for\n\nprofit or not for profit, limited liability company, partnership,\n\nlimited liability partnership, sole proprietorship, business trust,\n\njoint venture or other entity, but shall not mean the state, a\n\npolitical subdivision of the state, or a public or governmental\n\nentity, agency or instrumentality of the state;\n\n5. \"Project\" means real or personal property, or both, and\n\nimprovements thereto or in support thereof, including undivided and\n\nother interests therein, used for or in the provision of a public\n\nservice;\n\n6. \"Proposer\" means a private sector entity, a local or\n\nregional public entity or agency, or any group or combination\n\nthereof, submitting qualifications or a proposal for a public-\n\nprivate partnership contract;\n\n7. \"Public service\" means a service provided for a public\n\npurpose of a responsible state agency and identified in an\n\ninvitation for qualifications or proposals under the Oklahoma Public\n\nand Private Facilities and Infrastructure Act; and\n\n8. \"Responsible state agency\" means the agency, department,\n\ncommission, authority or other instrumentality of the state\n\nresponsible for the provision of the public service which is or is\n\nproposed to be the subject of a contract. Any such agency that is\n\nsubject to The Oklahoma Central Purchasing Act, the Public\n\nCompetitive Bidding Act, the Oklahoma State Finance Act and the\n\nOklahoma Privatization of the State Functions Act shall comply with\n\nthese laws.\n\nB. The Oklahoma Department of Transportation and the Oklahoma\n\nTurnpike Authority shall be exempt from the Oklahoma Public and\n\nPrivate Facilities and Infrastructure Act. However, the Oklahoma\n\nDepartment of Transportation and the Oklahoma Turnpike Authority may\n\nutilize the general provisions and process described herein to\n\ndevelop a public-private partnership contract for a transportation\n\nimprovement in consultation with the Director of OMES and subject to\n\nthe approval of the Oklahoma Transportation Commission or the\n\nOklahoma Turnpike Authority Board as applicable.","path":["OK Code","Title 74"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os74.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"096b9d456b0ea540fddfa9aacc474bad0d7e542ffddae4b7bf78ca104ecbd426","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-74-74-5151","next":"us-ok/okla.-stat.-tit.-74-74-5153"},"notice":"GroundRules: Original legal text.
