The responsible governmental entity may prepare a request\n\nfor proposal, which may include proposal stipends, and the proposed\n\npartnership contract, both of which shall be approved by the\n\nresponsible governmental entity. After the responsible governmental\n\nentity's approval of the request for proposal and the partnership\n\ncontract, the public project shall be deemed an Approved Partnership\n\nProcurement.\n\nB. Partnership contracts may contain the terms and conditions\n\nto carry out and effect the purposes of this act, including the\n\nduration of the contract, rates or fees for the public project to be\n\nprovided or methods or procedures for the determination of such\n\nrates or fees, standards for the public project to be provided,\n\nresponsibilities and standards for operation and maintenance of any\n\nrelated public project, required financial assurances, financial and\n\nother data reporting requirements, bases and procedures for\n\ntermination of the contract and retaking of possession or title to\n\nthe public project, and events of default and remedies upon default,\n\nincluding mandamus, a suit in equity, an action at law, or any\n\ncombination of those remedial actions.\n\nC. Partnership contracts may also include a requirement for the\n\ndelivery of performance and payment bonds required for all\n\nconstruction activities, and letters of credit, surety bonds or\n\nother security in connection with the development or operation of\n\nthe qualifying public project, in the forms and amounts satisfactory\n\nto the responsible governmental entity.\n\nD. After proposals are received, the responsible governmental\n\nentity, using the criteria established in the request for proposal,\n\nshall evaluate the proposals submitted and may hold discussions with\n\nproposers to further explore their proposals, the scope and nature\n\nof the public project, and the various technical approaches they may\n\ntake regarding the public project.\n\nE. The responsible governmental entity may reject any and all\n\nsubmissions of qualifications or proposals and may terminate the\n\nprocurement process at any point.\n\nF. The responsible governmental entity shall have the authority\n\nto make commercially reasonable changes to the partnership contract.\n\nAny such contract may contain the terms and conditions to carry out\n\nand effect the purposes of this act.\n\nG.
