This act shall be known and may be cited as the \"Oklahoma\n\nConsumer Energy Choice Act\".\n\nB. For the purposes of this act, \"energy source\" means any fuel\n\nor power source used to power an engine including but not limited to\n\nany of the following: aviation fuel, biofuel, compressed natural\n\ngas, diesel, electricity to be utilized for the charging of electric\n\nvehicles, gasoline, gas distillates, hydrogen, liquified petroleum\n\ngas, and renewable diesel.\n\nC. No city, town, county, or subdivision thereof shall adopt an\n\nordinance, rule, or code which limits consumer access to an energy\n\nsource or that results in the de facto prohibition of a wholesaler,\n\nretailer, energy producer, or the related infrastructure that is\n\nnecessary to provide consumer access to a specific energy source\n\nwithin the jurisdiction of a city, town, county, or subdivision\n\nthereof.\n\nD. For the purposes of promoting commerce and the equitable\n\ntreatment of the citizens of this state, limitations of consumer\n\naccess to an energy source by any city, town, county, or subdivision\n\nthereof is declared to be a statewide concern and shall be\n\nprohibited pursuant to subsection C of this section.","path":["OK Code","Title 74"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os74.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"c882ca84b97131339bbbc84418f12e5ecd936ef58da25b1cf1b36e03777ce66b","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-74-74-5167","next":"us-ok/okla.-stat.-tit.-74-74-52"},"notice":"GroundRules: Original legal text.
