Stat. tit. 74, § 74-582","heading":"Israel a prominent trading partner – Companies contracting","body":"with the state to certify they are not engaged in boycotts of\n\nIsrael.\n\nA. The State of Oklahoma hereby declares that Israel is a\n\nprominent trading partner of the State of Oklahoma and that the\n\nstate, and those companies that do business by and through the\n\nstate, in the interest of the state's economic policy, should not\n\nboycott trade with Israel. Companies that refuse to deal with\n\nUnited States trade partners such as Israel make discriminatory\n\ndecisions on the basis of national origin that impair those\n\ncompanies' commercial soundness. Israel is known for its dynamic\n\nand innovative approach in many business sectors, and a company's\n\ndecision to discriminate against persons or entities doing business\n\nin Israel or in territories controlled by Israel is an unsound\n\nbusiness practice making the company an unduly risky contracting\n\npartner. It is also the public policy of the United States, as\n\nenshrined in several federal acts, including 50 U.S.C., Section\n\n4607, to oppose such boycotts, and Congress has concluded as a\n\nmatter of national trade policy that cooperation with Israel\n\nmaterially benefits United States companies and improves American\n\ncompetitiveness.\n\nB. Except as provided in subsection D of this section, the\n\nstate shall not enter into a contract with a company unless the\n\ncompany submits a written certification that the company is not\n\ncurrently engaged in a boycott of goods or services from Israel that\n\nconstitutes an integral part of business conducted or sought to be\n\nconducted with the state.\n\nC. The state shall not adopt a procurement, investment or other\n\npolicy that has the effect of inducing or requiring a person to\n\nboycott the government of Israel or its instrumentalities, or to\n\nboycott a person doing business in Israel or territories under its\n\njurisdiction, when such boycott is on the basis of such person's\n\nlocation in such places.\n\nD. The Oklahoma Secretary of State shall approve contracts or\n\nmay waive application of this section on any contract with any state\n\nagency if the Secretary determines that compliance is not\n\npracticable.\n\nE. As used in this section:\n\n1. \"Boycott\" means engaging in a refusal to deal, terminating\n\nbusiness activities or performing other actions that are intended to\n\nlimit commercial relations with persons or entities doing business\n\nin Israel or in territories controlled by Israel, if those actions\n\nare taken either:\n\na. in compliance with or adherence to calls for a boycott\n\nof Israel other than those boycotts to which 50\n\nU.S.C., Section 4607(c) applies, or\n\nb. in a manner that discriminates on the basis of\n\nnationality, national origin or religion, and that is\n\nnot based on a valid business reason;\n\n2. \"Company\" means an organization, association, corporation,\n\npartnership, venture or other entity, its subsidiary or affiliate,\n\nthat exists for profitmaking purposes or to otherwise secure\n\neconomic advantage;\n\n3. \"Contract\" means a written agreement between the state and a\n\ncompany to acquire or dispose of goods or services with an aggregate\n\nprice of more than One Hundred Thousand Dollars ($100,000.00).\n\n\"Contract\" does not mean a written agreement between the state and\n\nan individual to acquire or dispose of goods or services, including\n\nemployment or consultant services; and\n\n4. \"State\" means this state or an agency, board, commission or\n\ndepartment of this state.","path":["OK Code","Title 74"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os74.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"8b3e46f11f94874ecba48816d5697a1eed6ea9cb00d8270d99630faa3ddf184a","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-74-74-581","next":"us-ok/okla.-stat.-tit.-74-74-583"},"notice":"GroundRules: Original legal text.
