Stat. tit. 74, § 74-589","heading":"Notification to employees of intent to privatize –","body":"Employee cost-saving recommendations.\n\nA. Upon a finding by the Office of Management and Enterprise\n\nServices pursuant to Section 588.1 of this title that the agency has\n\ncomplied with the requirements of the Oklahoma Privatization of\n\nState Functions Act, and before any agency can contract to privatize\n\na function, program, service, unit or division, the agency must\n\nprovide:\n\n1. Notification to employees impacted by the proposed\n\nprivatization by the agency of its intent to privatize a function,\n\nprogram, service, unit, or division of the agency;\n\n2. Notification to affected employees that they will have the\n\nopportunity to submit cost-savings recommendations for improving the\n\noperations, efficiency or organization of the entity being\n\nconsidered for privatization; and\n\n3. Notification by the agency simultaneously with the notice\n\nrequired pursuant to paragraph 1 of this subsection, to the Director\n\nof the Office of Management and Enterprise Services of the intent of\n\nthe agency to privatize a state function.\n\nB. Upon a request by the affected employees, the agency shall\n\nprovide information about the delivery of services to its employees\n\nas they develop recommendations to be considered. This information\n\nshall include revenue expenditure data, wage and salary data, an\n\ninventory of the supplies, equipment, and facilities associated with\n\nthe program being privatized, and the cost analysis performed by the\n\nagency.\n\nC. Any recommendations submitted by agency employees shall be\n\nconsidered by the agency, separate and apart from the bid process,\n\nwith nonemployee bids. The agency shall make the final\n\ndetermination whether to accept the winning nonemployee bid or\n\naccept the employee recommendations in lieu of the winning bid.\n\nD. After an agency has met the requirements of subsection A of\n\nthis section, the agency shall notify the Director of the Office of\n\nManagement and Enterprise Services, the Governor, the President Pro\n\nTempore of the Senate, and the Speaker of the House of\n\nRepresentatives of the intent of the agency to solicit bids in\n\naccordance with this section.\n\nE. The agency shall provide a comprehensive written analysis of\n\nthe contract cost based upon the designated bid, specifically\n\nincluding the costs of transition from public to private operation,\n\nseverance payments to agency employees, and monitoring and otherwise\n\nadministering contract performance.\n\nF. The agency shall require the following information prior to\n\nentering into a contract to privatize a function, program, service,\n\nunit, or division:\n\n1. Financial stability of the vendor, past and present\n\nlitigation, and references related to past government contract\n\nperformance information; and\n\n2. Detail how the vendor will perform the contract, including\n\nstaffing and equipment information.\n\nG. The agency shall establish a plan and cost analysis on how\n\nto return the privatized function, program, service, unit, or\n\ndivision to the state if there is a contract cancellation.\n\nH. Any contract with a vendor to privatize a function, program,\n\nservice, unit, or division shall require that the payment to the\n\ncontractor be linked to performance. The contract shall provide\n\nthat the amount agreed upon in the contract may be reduced if the\n\nagency experiences a budget shortfall.\n\nI. Each privatization contract shall contain provisions\n\nrequiring the contractor to offer available employee positions\n\npursuant to the contract to qualified regular employees of the\n\nagency whose state employment is terminated because of the\n\nprivatization contract and who satisfy the hiring criteria of the\n\ncontractor.","path":["OK Code","Title 74"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os74.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"0f35283251a0b2b37da84197cc415a48521d396ed85eb692bc3bf55419d65722","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-74-74-588.1","next":"us-ok/okla.-stat.-tit.-74-74-589.1"},"notice":"GroundRules: Original legal text.
