The Long-Range Capital Planning Commission shall work to\n\ndecrease the amount of property owned by Oklahoma state government,\n\nreturn state-owned property to private sector ownership, better\n\nmaintain and utilize the state’s needed capital assets, and,\n\nwhenever possible, eliminate the practice of state agencies leasing\n\nreal property not owned by the state.\n\nB. Each year, the Director of the Office of Management and\n\nEnterprise Services, at the direction of the Long-Range Capital\n\nPlanning Commission, shall take action to approve the privatization\n\nof state-owned real property as identified pursuant to the Oklahoma\n\nState Government Asset Reduction and Cost Savings Program. Proceeds\n\nfrom the liquidation of real properties shall be deposited into the\n\nMaintenance of State Buildings Revolving Fund.\n\nC. Prior to entering into or renewing a lease for real\n\nproperty, each state agency, board, commission, and public trust\n\nhaving the state as a beneficiary shall receive approval for\n\nentering into the lease from the Office of Management and Enterprise\n\nServices.\n\nD. Prior to making a purchase of real property or constructing\n\na building, each state agency, board, commission, and public trust\n\nhaving the state as a beneficiary shall receive approval for the\n\npurchase or construction from the Director of the Office of\n\nManagement and Enterprise Services; provided, if such purchase or\n\nconstruction is deemed by the Director of the Office of Management\n\nand Enterprise Services to be within the authority of the Long-Range\n\nCapital Planning Commission, the Director shall not approve the\n\npurchase or construction and shall refer the request to the\n\nCommission for action.\n\nE. Prior to approval or referral pursuant to subsection C or D\n\nof this section, the Office of Management and Enterprise Services\n\nshall determine if the applicant entity can utilize already existing\n\nstate-owned real property as an alternative to leasing non-state-\n\nowned real property or purchasing or constructing new real property.\n\nIf such existing state-owned real property is owned by the Oklahoma\n\nHistorical Society, is listed on the National Register of Historic\n\nPlaces or with the National Trust for Historic Preservation, or is\n\npotentially of historical significance, the Office of Management and\n\nEnterprise Services shall notify the Oklahoma Historical Society and\n\nobtain its approval prior to approving an application for its reuse.\n\nF. No state agency, board, commission, or public trust having\n\nthe state as its beneficiary shall transfer any real property owned\n\nby the agency, board, commission, or trust to any other state\n\nagency, board, commission, state beneficiary trust, or any public or\n\nprivate entity unless the transfer is first approved by the Long-\n\nRange Capital Planning Commission. Any transfer made without the\n\nprior approval of the Long-Range Capital Planning Commission as\n\nrequired by this subsection may be reversed by the Long-Range\n\nCapital Planning Commission and if a transfer is reversed the\n\nagency, board, commission, state beneficiary trust, or other state\n\ngovernment entity to which the real property has been impermissibly\n\ntransferred shall take such actions to convey the subject property\n\nto the entity from which the asset was acquired not later than\n\nthirty (30) days from the date an order for such transfer is entered\n\nby the Long-Range Capital Planning Commission. The Commission shall\n\nnot approve any transfer unless proceeds from the sale shall be\n\ndeposited within the Maintenance of State Buildings Revolving Fund\n\nas established by Section 908 of Title 62 of the Oklahoma Statutes.\n\nG. By February 1 of each year, the Office of Management and\n\nEnterprise Services shall publish a report for the preceding\n\ncalendar year listing the parcels of previously state-owned property\nsale shall be\n\ndeposited within the Maintenance of State Buildings Revolving Fund\n\nas established by Section 908 of Title 62 of the Oklahoma Statutes.\n\nG. By February 1 of each year, the Office of Management and\n\nEnterprise Services shall publish a report for the preceding\n\ncalendar year listing the parcels of previously state-owned property\n\nsold, detailing the reduction in the amount of space leased by the\n\nstate, describing the source of funds and expenditures from the\n\nMaintenance of State Buildings Revolving Fund, and showing the\n\nmanner in which deferred maintenance needs are being met. The\n\nreport shall be provided to the Governor, Speaker of the House of\n\nRepresentatives, and President Pro Tempore of the Senate and placed\n\non the documents.ok.gov web portal.\n\nH. This section shall not be applicable to the following or\n\ntheir lands, properties, buildings, funds, or revenue:\n\n1. The Oklahoma Ordnance Works Authority;\n\n2. The Commissioners of the Land Office;\n\n3. The Department of Transportation;\n\n4. The Oklahoma Turnpike Authority; and\n\n5. The Grand River Dam Authority.\n\nI. The Director of the Office of Management and Enterprise\n\nServices may make recommendations to the Long-Range Capital Planning\n\nCommission for liquidation of underutilized properties that have\n\nenvironmental issues, create a liability for the state, or create\n\nexpenses that make the continued ownership of the underutilized\n\nproperty undesirable and the property has been offered through two\n\npublic auctions or sealed bids and no viable bids were received. If\n\nthe Long-Range Capital Planning Commission approves the liquidation\n\nof the property, the Office of Management and Enterprise Services\n\nmay accept a bid of less than ninety percent (90%) of the appraised\n\nvalue in accordance with Section 327 of Title 61 of the Oklahoma\n\nStatutes.","path":["OK Code","Title 74"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os74.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"51669f4be9bae36fbe7249d14a6850c7944cb5b9d0aef8d629088493a9b2fbe5","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-74-74-61.7","next":"us-ok/okla.-stat.-tit.-74-74-61.9"},"notice":"GroundRules: Original legal text.
