Stat. tit. 74, § 74-7009","heading":"Participating agencies - Qualifications - Criteria -","body":"Applications.\n\nA. Participation in the State Charitable Campaign shall be\n\nlimited to voluntary, charitable, health and welfare agencies that\n\nprovide or support direct health and welfare services to individuals\n\nor their families and meet the criteria set out in this section.\n\nThe health and welfare services shall be available to state\n\nemployees, unless they are rendered to needy persons overseas. The\n\nservices shall directly benefit human beings, whether children,\n\nyouth, adults, the aged, the ill and infirm, or the mentally or\n\nphysically handicapped. The services shall consist of care,\n\nresearch, or education in the fields of human health or social\n\nadjustment and rehabilitation; relief for victims of natural\n\ndisasters and other emergencies; or assistance to those who are\n\nimpoverished and, therefore, in need of food, shelter, clothing, and\n\nbasic human welfare services.\n\nB. For the purposes of the State Charitable Campaign, basic\n\nhuman welfare service shall not include:\n\n1. Organizations whose primary purpose is the direct or\n\nindirect support of institutions of higher education;\n\n2. Lobbying; and\n\n3. Religious activities.\n\nC. To be included in the State Charitable Campaign, a voluntary\n\ncharitable agency, in addition to meeting the other requirements set\n\nforth in this section, shall:\n\n1. Be a nonprofit, tax-exempt charitable organization and\n\nsubmit to the participating federation a 501(c)(3) exemption from\n\nthe Internal Revenue Service;\n\n2. Be incorporated or authorized to do business in this state\n\nas a private, nonprofit organization;\n\n3. Register, annually, with the Secretary of State to solicit\n\nor accept contributions in this state;\n\n4. Submit to the participating federation an audit of the\n\nagency, conducted by an accounting firm or individual holding a\n\npermit to practice public accounting in this state according to the\n\ngenerally accepted standards of accounting for nonprofit\n\norganizations; and\n\n5. Submit to the participating federation a copy of the annual\n\nform 990.\n\nD. Applications to the State Charitable Campaign shall be\n\nsubmitted to the Oversight Committee for State Employee Charitable\n\nContributions from local federations which shall include United\n\nWays, United Funds, Combined Health Appeals, International Social\n\nService Agencies and any other local federation consisting of at\n\nleast five local agencies which meet the requirements of this\n\nsection. Each federation shall certify the application for its\n\nmember agencies and shall give state charitable agencies precedence\n\nover national agencies if both qualify for the charitable\n\ncontribution campaign.
