Stat. tit. 74, § 74-840-1.18","heading":"Payment for services – Citizen actions – Employee","body":"actions.\n\nA. Any state agency for which the Director provides payroll\n\nservices shall pay for such services at a rate established by the\n\nDirector, which shall be based upon the cost to the Director of\n\nproviding such services. Each agency shall remit payment for such\n\nservices quarterly from departmental or agency funds to the Director\n\nwho shall deposit such payments into the Human Capital Management\n\nRevolving Fund created in Section 840-1.20 of this title.\n\nB. No state disbursing or auditing officer shall make or\n\napprove or take any part in making or approving any payment for\n\npersonal service to any person holding a position in state service,\n\nbrought under law unless the payroll voucher or account of such pay\n\nbears the certification of the appointing authority or designee,\n\nthat the persons named therein have been appointed and employed in\n\naccordance with the provisions of law and the rules promulgated\n\nhereunder. The appointing authority or designee may for proper\n\ncause withhold certification from an entire payroll or from any\n\nspecific item or items thereon.\n\nAny citizen may maintain a suit to restrain a disbursing officer\n\nfrom making any payment in contravention of any provision of law or\n\nrules promulgated hereunder. Any sum paid contrary to any provision\n\nof law or any rule promulgated hereunder may be recovered in an\n\naction maintained by any citizen, from any officer who made,\n\napproved or authorized such payment or who signed or countersigned a\n\nvoucher, payroll, check or warrant for such payment, or from the\n\nsureties on the official bond of any such officer. All monies\n\nrecovered in any such action shall be paid into the State Treasury.\n\nAny person appointed or employed in contravention of any\n\nprovision of law or any rules or orders promulgated hereunder, whose\n\nemployment is brought within the terms of law, who performs service\n\nfor which he or she is not paid, may maintain an action against the\n\nofficer or officers who purported to appoint or employ the person to\n\nrecover the agreed pay for such services, or the reasonable value\n\nthereof if no pay was agreed upon. No officer shall be reimbursed\n\nby the state at any time for any sum paid to such person on account\n\nof such services.\n\nIf the appointing authority or designee wrongfully withholds\n\ncertification of the payroll voucher or account of any employee,\n\nsuch employee may maintain an action or proceeding in the courts to\n\ncompel the appointing authority or designee to certify such payroll\n\nvoucher or account.","path":["OK Code","Title 74"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os74.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"a1f623a3f28c92d694fb64ecf32c34a4fb12f07bb35a03cb49fce3a9b1395aa4","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-74-74-840-1.17","next":"us-ok/okla.-stat.-tit.-74-74-840-1.20"},"notice":"GroundRules: Original legal text.
