The federal Fair Labor Standards Act, 29 U.S.C., Section\n\n201, et seq., provides for minimum standards for overtime\n\nentitlement, and spells out administrative procedures by which\n\ncovered work time must be compensated. This section is not a\n\ncomprehensive listing of the provisions of the Fair Labor Standards\n\nAct and regulations promulgated thereunder, and is not intended to\n\nconflict with either the Act or the regulations. No agency, board,\n\ncommission, department, institution, bureau, executive officer or\n\nother entity of the executive branch shall exceed the minimum\n\novertime entitlement provisions of the Fair Labor Standards Act and\n\nregulations promulgated thereunder except as herein provided.\n\nB. Nothing in this title or the federal Fair Labor Standards\n\nAct shall be construed to prohibit an employer from paying an\n\nemployee who is required to work on a holiday, as defined in Section\n\n82.1 of Title 25 of the Oklahoma Statutes, for such work at a rate\n\nof two times the employee's regular hourly rate, or from\n\nrescheduling the holiday at the discretion of the appointing\n\nauthority; provided, however, any state employee who is required to\n\nwork on a holiday, as defined in Section 82.1 of Title 25 of the\n\nOklahoma Statutes, in the performance of fire suppression duties\n\nshall receive holiday pay at a rate of two times the employee's\n\nregular hourly rate.\n\nC. Any employee receiving compensatory time consistent with the\n\nprovisions of the federal Fair Labor Standards Act shall exhaust\n\nsuch compensatory time prior to the taking of annual leave, except\n\nwhere the employee is subject to losing such annual leave due to the\n\napplication of the accumulation limits in Section 840-2.20 of this\n\ntitle.\n\nD. An employee receiving compensatory time under the provisions\n\nof subsection A of this section shall be permitted to use accrued\n\ncompensatory time within one hundred eighty (180) days, except as\n\nprovided in subsection E of this section, following the day on which\n\nit was accrued, provided the taking of compensatory time does not\n\nunduly impact agency operations or the health, safety or welfare of\n\nthe public, or endanger public property. The balance of any unused\n\ncompensatory time received but not taken during this time period, if\n\npayable, shall be paid to the employee at the employee's current\n\nregular hourly rate.\n\nE. Following an emergency declaration as described in Section\n\n683.8 of Title 63 of the Oklahoma Statutes, the accumulation limits\n\nfor compensatory time shall temporarily increase and shall carryover\n\nto the end of the fiscal year following the year in which the\n\nemergency declaration ended.\n\nAll compensatory time that accrued or expired during the period\n\nof the emergency declarations issued by the Governor in 2020 and\n\n2021 in response to the novel coronavirus (COVID-19) shall carry\n\nover to the end of the fiscal year following the year in which the\n\nemergency declaration ended. Expired compensatory time governed by\n\nthis subsection shall be reinstated as of the effective date of this\n\nact, and accumulation limits for compensatory time shall not apply\n\nto amounts accrued or reinstated pursuant to this subsection.\n\nEligibility for reinstatement of compensatory time is limited to\n\nemployees currently employed by the State of Oklahoma on the\n\neffective date of this act.","path":["OK Code","Title 74"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os74.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"eb2e9ba4a9e49bd9be5f781201b02b7bde893ab75e5b25f9fa3d5ed68cd51b68","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-74-74-840-2.14","next":"us-ok/okla.-stat.-tit.-74-74-840-2.15a"},"notice":"GroundRules: Original legal text.
