Unless otherwise provided by the Oklahoma Constitution,\n\nstatutory authority to set or fix compensation, pay or salary of\n\nstate officers and employees shall not be construed to authorize any\n\nagency, board, commission, department, institution, bureau,\n\nexecutive officer or other entity of the executive branch of state\n\ngovernment to award, grant, give, authorize, or promise any officer\n\nor employee of the State of Oklahoma a raise that is inconsistent\n\nwith the compensation schedules established by the Office of\n\nManagement and Enterprise Services for all state officers and\n\nemployees in the executive branch pursuant to Section 840-4.6 of\n\nthis title, including, but not limited to, a cost-of-living raise or\n\nany other type of raise that would be given to state employees on an\n\nacross-the-board basis, except as herein provided. Such raises are\n\nprohibited unless authorized by the Legislature and by rules\n\npromulgated by the Director of the Office of Management and\n\nEnterprise Services. This prohibition applies to all officers and\n\nemployees in the executive branch of state government, excluding\n\ninstitutions under the administrative authority of the Oklahoma\n\nState Regents for Higher Education.\n\nB. However, nothing in this section shall be construed to\n\nprohibit the following actions if the action is made in good faith\n\nand not for the purpose of circumventing subsection A of this\n\nsection, and if the appointing authority certifies that the action\n\ncan be implemented for the current fiscal year and the subsequent\n\nfiscal year without the need for additional funding to increase the\n\npersonal services budget of the agency, and if the Office of\n\nManagement and Enterprise Services certifies that the action is\n\nconsistent with the compensation schedules established pursuant to\n\nthe provisions of Section 840-4.6 of this title:\n\n1. Salary advancements on promotion to a job family level or\n\nclass with a higher salary band;\n\n2. Salary adjustments resulting from a pay band change for a\n\njob family level or class adopted by the Office of Management and\n\nEnterprise Services;\n\n3. Increases in longevity payments pursuant to Section 840-2.18\n\nof this title;\n\n4. Payment of overtime, special entrance rates, pay\n\ndifferentials;\n\n5. Payment of wages, salaries, or rates of pay established and\n\nmandated by law;\n\n6. Market adjustments for job family levels tied to market\n\ncompetitiveness;\n\n7. Intra-agency lateral transfers, provided that the adjustment\n\ndoes not exceed five percent (5%) and the adjustment is based on the\n\nneeds of the agency;\n\n8. Skill-based adjustments. Such adjustments, which are\n\nimplemented before November 1, 2006, other than lump-sum payments,\n\nshall become permanent after twenty-four (24) months from the date\n\nsuch salary adjustment is implemented and may not later be removed\n\nfrom an employee's base salary if a furlough or reduction-in-force\n\nis implemented by the appointing authority granting such salary\n\nadjustment. Skill-based pay adjustments, which are implemented on\n\nor after November 1, 2006, and which are paid to an employee, shall\n\nbe paid as long as the employee remains employed in the position and\n\nperforms the skills for which the differential is due, but shall not\n\nbe included as a part of the employee's base salary;\n\n9. Equity-based adjustments;\n\n10. Performance-based adjustments for employees who received at\n\nleast a \"meets standards\" rating on their most current performance\n\nrating;\n\n11. Career progression increases as an employee advances\n\nthrough job family levels; or\n\n12. Salary adjustments not to exceed five percent (5%) for\n\nprobationary employees achieving permanent status following the\n\ninitial probationary period and permanent employees successfully\n\ncompleting trial periods after intra-agency lateral transfer or\n\npromotion to a different job family level or following career\n\nprogression to a different job family level.\nnces\n\nthrough job family levels; or\n\n12. Salary adjustments not to exceed five percent (5%) for\n\nprobationary employees achieving permanent status following the\n\ninitial probationary period and permanent employees successfully\n\ncompleting trial periods after intra-agency lateral transfer or\n\npromotion to a different job family level or following career\n\nprogression to a different job family level.\n\nC. The pay movement mechanisms described in paragraphs 6\n\nthrough 11 in subsection B of this section shall be implemented\n\npursuant to rules promulgated by the Director of the Office of\n\nManagement and Enterprise Services.\n\nD. Appointing authorities may implement the pay movement\n\nmechanisms in paragraphs 6 through 12 in subsection B of this\n\nsection subject to the availability of funds within the agency's\n\nbudget for the current fiscal year and subsequent fiscal year\n\nwithout the need for additional funding to increase the personal\n\nservices budget of the agency. Failure by the appointing authority\n\nto follow the provisions of this subsection may cause the withdrawal\n\nof the use of the pay movement mechanisms provided in paragraphs 6,\n\n7, 9, 10 and 11 of subsection B of this section within the agency\n\nduring the next appropriations cycle.\n\nE. The provisions in subsection B of this section shall not\n\napply to chief executive officers of any agency, board, commission,\n\ndepartment or program except for paragraphs 3 and 5 of subsection B\n\nof this section.\n\nF. The Office of Management and Enterprise Services shall file\n\na quarterly report with the Offices of the Governor, Speaker of the\n\nOklahoma House of Representatives, and President Pro Tempore of the\n\nOklahoma State Senate listing, by agency, all increases in wages,\n\nsalaries or rates of pay and any changes to title or classification\n\nof each employee.","path":["OK Code","Title 74"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os74.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"2d689f367cd04b3a8cf0a44cfdcbd49395cbe42e7253636537e9b617b95d7633","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-74-74-840-2.17","next":"us-ok/okla.-stat.-tit.-74-74-840-2.17v2"},"notice":"GroundRules: Original legal text.
