Unless otherwise provided by the Oklahoma Constitution,\n\nstatutory authority to set or fix compensation, pay or salary of\n\nstate officers and employees shall not be construed to authorize any\n\nagency, board, commission, department, institution, bureau,\n\nexecutive officer or other entity of the executive branch of state\n\ngovernment to award, grant, give, authorize, or promise any officer\n\nor employee of the State of Oklahoma a raise that is inconsistent\n\nwith the compensation schedules established by the Office of\n\nManagement and Enterprise Services for all state officers and\n\nemployees in the executive branch, including, but not limited to, a\n\ncost-of-living raise or any other type of raise that would be given\n\nto state employees on an across-the-board basis, except as herein\n\nprovided. Such raises are prohibited unless authorized by the\n\nLegislature and by rules promulgated by the Director. This\n\nprohibition applies to all officers and employees in the executive\n\nbranch of state government, excluding institutions under the\n\nadministrative authority of the Oklahoma State Regents for Higher\n\nEducation.\n\nB. However, nothing in this section shall be construed to\n\nprohibit the following actions if the action is made in good faith\n\nand not for the purpose of circumventing subsection A of this\n\nsection, and if the appointing authority certifies that the action\n\ncan be implemented for the current fiscal year and the subsequent\n\nfiscal year without the need for additional funding to increase the\n\npersonal services budget of the agency, and if the Office of\n\nManagement and Enterprise Services certifies that the action is\n\nconsistent with the compensation schedules established pursuant to\n\nthe provisions of this act:\n\n1. Salary advancements on promotion;\n\n2. Salary adjustments resulting from a pay change for a job\n\nlevel adopted by the Office of Management and Enterprise Services;\n\n3. Increases in longevity payments pursuant to Section 840-2.18\n\nof this title;\n\n4. Payment of overtime, special entrance rates, pay\n\ndifferentials;\n\n5. Payment of wages, salaries, or rates of pay established and\n\nmandated by law;\n\n6. Market adjustments for jobs tied to market competitiveness;\n\n7. Skill-based adjustments;\n\n8. Equity-based adjustments;\n\n9. Performance-based adjustments; or\n\n10. Career progression increases as an employee advances\n\nthrough job levels.\n\nC. Provided, however, any salary increase for one of the\n\npurposes provided in subsection B of this section that would require\n\nadditional funding by the Legislature shall not be implemented\n\nwithout approval of the Legislature.\n\nD. Appointing authorities may implement the pay movement\n\nmechanisms subject to the availability of funds within the agency's\n\nbudget for the current fiscal year and subsequent fiscal year\n\nwithout the need for additional funding to increase the personal\n\nservices budget of the agency. Failure by the appointing authority\n\nto follow the provisions of this subsection may cause the withdrawal\n\nof the use of the pay movement mechanisms of this section within the\n\nagency during the next appropriations cycle.\n\nE. The Office of Management and Enterprise Services shall file\n\na quarterly report with the Offices of the Governor, President Pro\n\nTempore of the Senate and Speaker of the House of Representatives\n\nlisting, by agency, all increases in wages, salaries or rates of pay\n\nand any changes to title or classification of each employee.","path":["OK Code","Title 74"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os74.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"4e5bbf7d65ec8b65c2acc805c6676305c259acd1b203379729f32a5e373960d2","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-74-74-840-2.17v1","next":"us-ok/okla.-stat.-tit.-74-74-840-2.18"},"notice":"GroundRules: Original legal text.
