Any employee of this state, its departments or agencies\n\nshall be granted a leave of absence, subject to approval of the\n\nscheduling of such leave by the employee’s Appointing Authority,\n\nwith medical necessity being the primary determinant for such\n\napproval, for the time specified for the following purposes:\n\n1. Five (5) workdays to serve as a bone marrow donor if the\n\nemployee provides the employer written verification that the\n\nemployee is to serve as a bone marrow donor; and\n\n2. Thirty (30) workdays to serve as a human organ donor if the\n\nemployee provides the employer written verification that the\n\nemployee is to serve as a human organ donor.\n\nB. An employee who is granted a leave of absence pursuant to\n\nthe provisions of this section shall receive the base state pay\n\nwithout interruption during the leave of absence. For purposes of\n\ndetermining seniority, pay or pay advancement, and performance\n\nawards, and for the receipt of any benefit that may be affected by a\n\nleave of absence, the service of the employee shall be considered\n\nuninterrupted by the leave of absence.\n\nC. A state agency shall not penalize an employee for requesting\n\nor obtaining a leave of absence pursuant to the provisions of this\n\nsection.\n\nD.
