Stat. tit. 74, § 74-840-2.27E","heading":"Separation agreement","body":"Any affected employee who receives severance benefits pursuant\n\nto the State Government Reduction-in-Force and Severance Benefits\n\nAct shall execute a separation agreement with the employing agency,\n\non forms to be prescribed by the Director of the Office of\n\nManagement and Enterprise Services. The forms shall comply with\n\napplicable federal laws and may include but not be limited to the\n\nfollowing elements:\n\n1. Agreement by the affected employee that the receipt of the\n\nbenefits is in lieu of continued employment with the agency or other\n\nseverance benefits related to the current reduction-in-force;\n\n2. Agreement by the affected employee that, to the extent\n\nallowed by federal or state law, respectively, the affected employee\n\nreleases the State of Oklahoma and the agency from all claims,\n\nliabilities, demands and causes of action known or unknown, fixed or\n\ncontingent, equitable, legal or administrative, except unemployment\n\ninsurance;\n\n3. Agreement by the affected employee that, to the extent\n\nallowed by federal or state law, respectively, the affected employee\n\nreleases the State of Oklahoma and the agency from any claim or\n\ncause of action which might arise under federal or state laws\n\ngoverning the employment relationship; and\n\n4. Agreement by the affected employee that the affected\n\nemployee knows and understands that the receipt of severance\n\nbenefits is in exchange, to the extent allowed by federal or state\n\nlaw, for any rights the affected employee may have had to:\n\na. continued employment with any agency, and\n\nb. future employment with the agency from which separated\n\nfor a period of one (1) year from the date of the\n\nagreement, provided that nothing in this subparagraph\n\nshall prohibit an appointing authority of any agency\n\nfrom employing an affected employee who has received a\n\nseverance benefit.\n\nThe provisions of this section shall not prohibit any affected\n\nemployee from accepting severance benefits from more than one agency\n\nduring employment with the State of Oklahoma.","path":["OK Code","Title 74"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os74.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"38d426bd503384a43cf9360d8633a94e9d5d3915f9629826a031b9d46ac1b3bb","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-74-74-840-2.27d","next":"us-ok/okla.-stat.-tit.-74-74-840-2.30"},"notice":"GroundRules: Original legal text.
