Stat. tit. 74, § 74-840-2.30","heading":"Payment for time not worked - Public accountability –","body":"Department of Public Safety employee exemption and requirements.\n\nA. It is the policy of the State of Oklahoma to be accountable\n\nto state taxpayers for the expenditure of public funds. To this\n\nend, all state employees shall be paid according to a pay system\n\nestablished pursuant to the principles of public accountability that\n\nprohibits payment to any state employee for time not worked unless\n\nthe time not worked is covered by available paid leave. Violation\n\nof this provision may result in disciplinary action and criminal\n\nprosecution under Oklahoma law.\n\nB. 1. The Department of Public Safety shall be exempt from the\n\nprovisions of subsection A of this section as it relates to holiday\n\nleave for employees of the Department of Public Safety appointed by\n\nthe Commissioner of Public Safety pursuant to subsection A of\n\nSection 2-105 of Title 47 of the Oklahoma Statutes.\n\n2. Notwithstanding the dates to be observed as holidays in\n\n2009, as specified and approved by the Governor pursuant to Section\n\n82.1 of Title 25 of the Oklahoma Statutes, on the effective date of\n\nthis act the Department of Public Safety shall schedule and grant\n\nholiday leave for employees prescribed in paragraph 1 of this\n\nsubsection as is necessary to appropriately perform the functions of\n\nthe Oklahoma Highway Patrol Division of the Department, regardless\n\nof whether the holiday leave is granted on, before, or after the\n\nactual date of the holiday specified and approved by the Governor.\n\n3. For the calendar year beginning January 1, 2010, and for\n\neach calendar year thereafter, all leave hours for the number of\n\nholidays to be observed in the calendar year, as specified and\n\napproved by the Governor pursuant to Section 82.1 of Title 25 of the\n\nOklahoma Statutes, shall accrue in total on January 1 of the\n\ncalendar year for each employee prescribed in paragraph 1 of this\n\nsubsection. Notwithstanding the dates to be observed as holidays in\n\nthe calendar year, the Department of Public Safety shall schedule\n\nand grant holiday leave for the calendar year for employees\n\nprescribed in paragraph 1 of this subsection as is deemed necessary\n\nto appropriately perform the functions of the Oklahoma Highway\n\nPatrol Division of the Department, regardless of whether the holiday\n\nleave is granted on, before, or after the actual date of the holiday\n\nspecified and approved by the Governor.\n\n4. The Department shall schedule and grant for each employee\n\nspecified in paragraph 1 of this subsection and the employee shall\n\nuse holiday leave, as specified in this subsection, in eight-hour\n\nincrements or multiples of eight-hour increments; provided:\n\na. the Department shall not schedule and grant for any\n\nemployee and the employee shall not use more holiday\n\nleave in any calendar year than is specified and\n\napproved by the Governor for that calendar year,\n\npursuant to Section 82.1 of Title 25 of the Oklahoma\n\nStatutes, and\n\nb. the Department shall schedule and grant for each\n\nemployee and the employee shall use all holiday leave\n\nduring the calendar year in which it is specified and\n\napproved by the Governor. Holiday leave shall not\n\ncarry over from one (1) calendar year to the next\n\ncalendar year.\n\n5. If an employee prescribed in paragraph 1 of this subsection\n\nleaves the service of the state, and the Department has scheduled\n\nand granted the employee and the employee has used holiday leave\n\nwhich is in excess of the number of holidays left in the calendar\n\nyear during which the employee leaves the service of the state, the\n\nDepartment shall deduct the number of excess hours of holiday leave\n\nused by the employee from the accrued annual leave of the employee.","path":["OK Code","Title 74"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os74.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"230f813812143421dfb2bbc7573a841c6d1d05729812eb59af62af60456dc0b1","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-74-74-840-2.27e","next":"us-ok/okla.-stat.-tit.-74-74-840-2.7"},"notice":"GroundRules: Original legal text.
