Stat. tit. 74, § 74-840-3.1A","heading":"Authorization for agencies to establish education and","body":"training programs.\n\nA. For the purpose of this section, \"agency\" is any agency or\n\ndepartment of the executive branch.\n\nB. Beginning November 1, 2016, agencies are authorized to\n\nestablish education and training programs for positions critical to\n\nthe mission of the agency. The agency may contract with accredited\n\ninstitutions located in Oklahoma necessary to provide this education\n\nand training. Funds of the agency or its institutions may be used\n\nto pay salaries or tuition and subsistence for employees in these\n\ntraining programs, pursuant to subsection D of this section.\n\nEmployees may be in work status while engaging in training and\n\neducation programs provided for in this section.\n\nC. An employee of an agency, who has achieved a \"meets\" or\n\n\"exceeds\" standards on his or her performance evaluation and meets\n\nthe standards as established in rules promulgated pursuant to this\n\nsection, shall be eligible for additional education and training\n\nprovided by the state.\n\nD. An employee of the agency who participates in the education\n\nand training program outlined in this act shall execute a promissory\n\nnote for expenses payable to the agency whereby the employee\n\npromises to repay the note by remaining in employment with the\n\nagency. The duration of the loan repayment will correspond with the\n\nprogram in which the employee participated as set forth in rules\n\npromulgated for the implementation of this act.\n\nE. The amount due pursuant to this act shall be reduced at a\n\nrate of Thirteen Dollars ($13.00) per calendar day beginning the\n\nfirst day after graduation from the education or training program.\n\nIf for any reason the employee leaves the employment of the agency,\n\nthe obligation will be considered due.\n\nF. Violation of the provisions of the terms of the promissory\n\nnote for training expenses entered into pursuant to this section\n\nshall give rise to a cause of action and suit may be commenced by\n\nthe agency for and on behalf of the State of Oklahoma for\n\nrestitution of any and all sums plus interest at the statutory rate,\n\ncosts, and reasonable attorney fees. The provisions of this section\n\nshall not apply to persons who volunteer or are drafted into active\n\nmilitary service subsequent to receiving training at state expense.\n\nG. The agency of the executive branch may pay fees for\n\nemployees to maintain licenses and certification required to provide\n\nservices essential to the mission of the agency. The agency may\n\nrequire repayment of such fees pursuant to subsection D of this\n\nsection.\n\nH.
