Stat. tit. 74, § 74-85.22","heading":"Competitive bid or contract for goods or services – Form","body":"of certification.\n\nAny competitive bid submitted to this state or contract executed\n\nby the state for an acquisition in excess of the fair and reasonable\n\nacquisition threshold amount shall contain a certification, dated\n\nand in substantially the following form:\n\nA. I certify:\n\n1. I am the duly authorized agent of _____________, for the\n\npurpose of certifying facts pertaining to the existence of collusion\n\namong and between bidders and suppliers and state officials or\n\nemployees, as well as facts pertaining to the giving or offering of\n\nthings of value to government personnel in return for special\n\nconsideration in connection with the prospective acquisition;\n\n2. I am fully aware of the facts and circumstances surrounding\n\nthe acquisition or making of the bid to which this statement relates\n\nand have been personally and directly involved in events leading to\n\nthe acquisition or submission of such bid; and\n\n3. Neither the business entity that I represent in this\n\ncertification nor anyone subject to the business entity's direction\n\nor control has been a party:\n\na. to any collusion among bidders or suppliers in\n\nrestraint of freedom of competition by agreement to\n\nbid or contract at a fixed price or to refrain from\n\nbidding or contracting,\n\nb. to any collusion with any state official or employee\n\nas to quantity, quality or price in the prospective\n\ncontract, or as to any other terms of such prospective\n\ncontract, nor\n\nc. to any discussions between bidders or suppliers and\n\nany state official concerning exchange of money or\n\nother thing of value for special consideration in\n\nconnection with the prospective contract.\n\nB.
