Stat. tit. 74, § 74-85.3","heading":"Purchasing Division - Director - Employees -","body":"Encouragement of certain purchases - Conflict of interest.\n\nA. There is hereby created and established in the Office of\n\nManagement and Enterprise Services a Purchasing Division, the\n\nadministrative head of which shall be the State Purchasing Director.\n\nB. The Director of the Office of Management and Enterprise\n\nServices shall hire the State Purchasing Director. The State\n\nPurchasing Director shall:\n\n1. Have a thorough knowledge of office practices and buying\n\nprocedures in volume purchasing; and\n\n2. Be a graduate of an accredited college or university with at\n\nleast five (5) years' experience in commercial or governmental\n\npurchasing, or, in lieu of such education, have at least ten (10)\n\nyears' experience in commercial or governmental purchasing.\n\nC. The State Purchasing Director, with the approval of the\n\nDirector of the Office of Management and Enterprise Services, may\n\nemploy such personnel as may be necessary to exercise authority and\n\nperform duties under the Oklahoma Central Purchasing Act.\n\nD. All activities of any state agency, department, or\n\ninstitution relating to purchasing shall be under the direction of\n\nthe Purchasing Division unless otherwise provided by the Oklahoma\n\nCentral Purchasing Act.\n\nE. The Purchasing Division shall provide qualified personnel to\n\nassist the purchasing activities of state agencies, departments, and\n\ninstitutions, as required by the Oklahoma Central Purchasing Act.\n\nF. Each state agency, department, and institution shall\n\ndesignate personnel to coordinate its purchasing functions with the\n\nPurchasing Division.\n\nG. The Purchasing Division may, if the needs of a state agency,\n\ndepartment, or institution are such as to so require, employ, and\n\nestablish a buyer within a state agency. The state agency shall pay\n\nall expenses incurred for any buyer required to be placed within its\n\nagency.\n\nH. Except as provided in Section 34.36 of Title 62 of the\n\nOklahoma Statutes, no state agency subject to the Oklahoma Central\n\nPurchasing Act shall have or maintain a purchasing section without\n\nthe prior approval in writing of the Purchasing Division unless\n\notherwise provided in the Oklahoma Central Purchasing Act nor shall\n\nsuch purchasing section perform purchasing functions for another\n\nstate agency.\n\nI. The Purchasing Division shall make acquisitions from\n\nindustries operated by the Department of Corrections pursuant to the\n\nprovisions of Section 549.1 of Title 57 of the Oklahoma Statutes.\n\nJ. None of the personnel authorized by this section shall:\n\n1. Sell to or otherwise provide acquisitions to any state\n\nagency subject to the Oklahoma Central Purchasing Act;\n\n2. Be employees, partners, associates, officers, or\n\nstockholders in or with any business entity that sells to or\n\notherwise provides acquisitions to any state agency subject to the\n\nOklahoma Central Purchasing Act;\n\n3. Be employed in any of the positions authorized by this\n\nsection if a spouse or child owns any stock in any business entity\n\nwhich sells to or otherwise provides acquisitions to any agency\n\nsubject to the Oklahoma Central Purchasing Act;\n\n4. Be employed in any of the positions authorized by this\n\nsection if a relative within the third degree of consanguinity or\n\naffinity sells to or otherwise provides acquisitions to any state\n\nagency subject to the Oklahoma Central Purchasing Act or is\n\ninterested in any business entity which does so, except that such\n\nrelative, excluding a spouse or child, may own Twenty-five Thousand\n\nDollars ($25,000.00) worth or less, or one percent (1%) or less,\n\nwhichever amount is the lesser amount, of the stock of a corporation\n\nor any business entity which sells to or otherwise provides\n\nacquisitions to any state agency subject to the Oklahoma Central\n\nPurchasing Act; or\n\n5. Violate applicable rules of the Ethics Commission\n\npromulgated pursuant to Article XXIX of the Oklahoma Constitution\nllars ($25,000.00) worth or less, or one percent (1%) or less,\n\nwhichever amount is the lesser amount, of the stock of a corporation\n\nor any business entity which sells to or otherwise provides\n\nacquisitions to any state agency subject to the Oklahoma Central\n\nPurchasing Act; or\n\n5. Violate applicable rules of the Ethics Commission\n\npromulgated pursuant to Article XXIX of the Oklahoma Constitution\n\nthat relate to accepting gifts from a vendor or a vendor's agent.\n\nK. Any state agency, department, institution, or satellite\n\noffice thereof that is otherwise subject to the provisions of the\n\nOklahoma Central Purchasing Act, but is located in a county without\n\nstatewide contracted vendors, may elect to purchase necessary\n\nequipment and supplies from a local business at or below state\n\ncontract pricing without first obtaining a waiver from or the\n\npermission of the Purchasing Division after seventy-two (72) hours\n\nfrom providing written or electronic notice to the Central\n\nPurchasing Director of said purchase in an amount not to exceed Two\n\nThousand Five Hundred Dollars ($2,500.00). Any state agency that\n\nelects to make purchases from local vendors pursuant to this\n\nsubsection shall maintain a document file for each acquisition the\n\nstate agency makes, which shall include, at a minimum, justification\n\nfor the acquisition, supporting documentation, copies of all\n\ncontracts, if any, pertaining to the acquisition, evaluations,\n\nwritten reports, if required by contract, and any other information\n\nthe State Purchasing Director requires.","path":["OK Code","Title 74"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os74.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"63a977c38345749043172c837795fbe06b202c8f4e477e3177470f1487cbaa69","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-74-74-85.29","next":"us-ok/okla.-stat.-tit.-74-74-85.30"},"notice":"GroundRules: Original legal text.
