A state agency that acquires professional services shall\n\ncomply with the provisions of this section.\n\nB. The state agency may evaluate the performance of the\n\nprofessional services provided pursuant to all professional services\n\ncontracts exceeding the fair and reasonable acquisition threshold\n\namount. The performance evaluation shall indicate the quality of\n\nservice or work product of the supplier. The state agency shall\n\nretain the evaluation in the document file the state agency\n\nmaintains for the acquisition pursuant to Section 85.39 of this\n\ntitle. If the evaluation indicates deficiencies with the supplier's\n\nwork, the state agency shall send a copy of the evaluation to the\n\nState Purchasing Director.\n\nC. If the work product of the contract is a report subject to\n\ndisclosure under state or federal law or regulation, the state\n\nagency shall file the report with the State Librarian and Archivist.\n\nD. A state agency shall administer, monitor and audit the\n\nprofessional services contract and may be required to report the\n\nstatus of an unfinished professional services contract to the State\n\nPurchasing Director.\n\nE. A professional services contract shall include an audit\n\nclause which provides that all items of the supplier that relate to\n\nthe professional services are subject to examination by the state\n\nagency, the State Auditor and Inspector and the State Purchasing\n\nDirector.\n\nF. Except for a contract renewal, the final product of the\n\nprofessional services contract is a written proposal, report or\n\nstudy, the professional services contract shall require the supplier\n\nto certify that the supplier has not previously provided the state\n\nagency or another state agency with a final product that is a\n\nsubstantial duplication of the final product of the proposed\n\ncontract.","path":["OK Code","Title 74"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os74.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"82a58c7b067de2cb339916aa2f632a19aa2a9927e1781674b954434986fa8b75","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-74-74-85.40","next":"us-ok/okla.-stat.-tit.-74-74-85.41a"},"notice":"GroundRules: Original legal text.
