Emergency acquisitions shall be made in compliance with\n\nSection 85.39 of Title 74 of the Oklahoma Statutes regarding\n\ninternal purchasing procedures, Section 85.5a of Title 74 of the\n\nOklahoma Statutes regarding the purchasing card program and\n\napplicable rules but are not subject to other provisions of the\n\nOklahoma Central Purchasing Act. The following are emergency\n\nacquisitions:\n\n1. An acquisition declared as an emergency by a state agency;\n\n2. An acquisition to alleviate a serious environmental\n\nemergency if, upon receiving a request from the Chair of the\n\nCorporation Commission and after having examined the facts and\n\ncircumstances of the case, the Governor certifies in writing the\n\nexistence of a serious environmental emergency. For the purposes of\n\nthis subsection, \"serious environmental emergency\" means a situation\n\nwithin the jurisdiction of the Commission:\n\na. in which serious damage to the environment will\n\nquickly occur if immediate action is not taken and the\n\ndamage will be so significant that the urgent need for\n\naction outweighs the need for competitive bids, or\n\nb. a situation in which human life or safety is in\n\nimminent danger or significant property interests are\n\nthreatened with imminent destruction;\n\n3. An acquisition of livestock through a market agency, dealer,\n\ncommission house or livestock auction market bonded or licensed\n\nunder federal or state law for the acquisition or collection of\n\nsemen or embryos, and for the placement of embryos into recipient\n\nlivestock;\n\n4. An acquisition by a state agency pursuant to a contract with\n\nthe United States Army Corps of Engineers for emergency response or\n\nto protect the public health, safety or welfare;\n\n5. An acquisition declared by the Office of Management and\n\nEnterprise Services (OMES) Risk Management Administrator pursuant to\n\nSection 85.58A of Title 74 of the Oklahoma Statutes; or\n\n6. A condition certified by the Governor as an emergency.\n\nB.
