For competitive bids submitted to the state pursuant to the\n\nOklahoma Central Purchasing Act or pursuant to the Public\n\nCompetitive Bidding Act of 1974 by certified minority businesses,\n\nthe State Purchasing Director shall prepare and implement a bid-\n\npreference program. The program shall require that a percentage be\n\nadded to the price of the lowest bid and if the certified minority\n\nbusiness enterprise submits a bid that falls between the lowest bid\n\nplus the percentage, it shall receive the contract.\n\nProvided however, in no instance shall the minority business\n\nenterprise be entitled to both a minority bid preference under this\n\nact and the preference for state-produced goods pursuant to Section\n\n85.32 of this title.\n\nB. The minority business enterprise preference program shall be\n\nimplemented on the following schedule:\n\n1. For the 1988-1989 fiscal year, the State Purchasing Director\n\nshall certify the percent of funds expended on state contracts which\n\nhave been awarded to minority business enterprises certified\n\npursuant to Section 7 of this act. If the State Purchasing Director\n\ncertifies that a minimum of ten percent (10%) of the funds expended\n\non state contracts were expended on contracts awarded to minority\n\nbusiness enterprises certified pursuant to Section 7 of this act\n\nthen the minority percentage bid preference shall be zero. If the\n\npercentage of such funds expended on minority business enterprises\n\nis less than ten percent (10%) then a five percent (5%) bid\n\npreference shall go into effect; and\n\n2. For each following fiscal year, the State Purchasing\n\nDirector shall certify the percent of funds expended on state\n\ncontracts which have been awarded to minority business enterprises.\n\nWhen the State Purchasing Director certifies that a minimum of ten\n\npercent (10%) of the funds expended on state contracts are expended\n\non contracts awarded to minority business enterprises then the\n\npercentage bid preference shall remain at that preference level for\n\na period of one (1) year. After that one-year period, unless the\n\nminority bid preference level is zero, the State Purchasing Director\n\nshall reduce by one percent (1%) each year the bid preference level\n\nunless the required percent of funds expended on state contracts\n\nawarded to minority business enterprises decreases below the ten\n\npercent (10%) minimum. At that time, the State Purchasing Director\n\nshall increase the percentage bid preference one percent (1%) each\n\nyear to a maximum of five percent (5%) to attain the minimum ten\n\npercent (10%) goal of the program. Each year the State Purchasing\n\nDirector may increase or decrease the bid percentage level in\n\ncompliance with this section to maintain the minimum ten percent\n\n(10%) goal of the program.\n\nC.
