Any minority business enterprise that desires to participate\n\nin the minority bid preference program and to bid upon any state\n\ncontract within the purview of the State Purchasing Director of the\n\nOffice of Management and Enterprise Services or any other state\n\ncontract to be let by any state agency not subject to The Oklahoma\n\nCentral Purchasing Act shall first apply to the State Purchasing\n\nDirector of the Office of Management and Enterprise Services for\n\ncertification.\n\nB. The State Purchasing Director of the Office of Management\n\nand Enterprise Services shall certify a business which meets the\n\neligibility requirement of this section to qualify as a minority\n\nbusiness enterprise. To qualify as a minority business enterprise,\n\nthe business shall:\n\n1. Be a minority business enterprise;\n\n2. Submit any documentary evidence required by the rules and\n\nregulations of the Office of Management and Enterprise Services to\n\nsupport its status as a minority business enterprise;\n\n3. Sign an affidavit stating that it is a minority business\n\nenterprise;\n\n4. Be qualified to bid pursuant to the provisions of The\n\nOklahoma Central Purchasing Act; and\n\n5. Present:\n\na. an application including the entire business history of\n\nthe operation,\n\nb. birth certificates for all minority principals,\n\nc. if Native American, tribal registration\n\ncard/certificate,\n\nd. current resumes on all principals, key managers and\n\nother key personnel,\n\ne. a current financial statement,\n\nf. proof of investment by principals,\n\ng. loan agreements,\n\nh. lease/rental agreement for space, equipment,\n\ni. evidence of latest bond,\n\nj. if the applicant is a sole proprietor, he shall also\n\ninclude: a copy of a bank signature card,\n\nk. if the applicant is a partnership a copy of the\n\npartnership agreement shall also be included, and\n\nl. if the applicant is a corporation it shall also\n\ninclude: articles of organization, corporation bylaws,\n\ncopies of all stock certificates, minutes of the first\n\ncorporate organizational meeting, bank resolution on\n\nall company accounts, and a copy of the latest U.S.\n\ncorporate tax return.\n\nC. The State Purchasing Director of the Office of Management\n\nand Enterprise Services shall prepare and maintain a list of\n\ncertified minority business enterprises.\n\nD. The State Purchasing Director of the Office of Management\n\nand Enterprise Services may deny certification to any minority\n\nbusiness enterprise in accordance with the provisions of this act\n\nand the rules and regulations of the Office of Management and\n\nEnterprise Services.
