It shall be unlawful for a person to:\n\n1. Knowingly and with intent to defraud, fraudulently obtain,\n\nretain, attempt to obtain or retain, or aid another in fraudulently\n\nobtaining or retaining or attempting to obtain or retain,\n\ncertification as a minority business enterprise for the purposes of\n\nthis act.\n\n2. Knowingly and willfully make a false statement with the\n\nintent to defraud, whether by affidavit, report, or other\n\nrepresentation, to a state official or employee for the purpose of\n\ninfluencing the certification or denial of certification of any\n\nentity as a minority business enterprise.\n\n3. Knowingly and willfully obstruct, impede, or attempt to\n\nobstruct or impede any state official or employee who is\n\ninvestigating the qualifications of a business entity which has\n\nrequested certification as a minority business enterprise.\n\n4. Knowingly and willfully with intent to defraud, fraudulently\n\nobtain, attempt to obtain, or aid another person in fraudulently\n\nobtaining or attempting to obtain, public monies to which the person\n\nis not entitled under this act.\n\n5. Knowingly and willfully assign any contract awarded pursuant\n\nto the Oklahoma Minority Business Enterprise Assistance Act to any\n\nother business enterprise without prior written approval of the\n\nState Purchasing Director pursuant to Section 85.45g of this title.\n\nB. Any person convicted of violating any provision of the\n\nOklahoma Minority Business Enterprise Assistance Act shall be guilty\n\nof a Class D1 felony offense, punishable by imprisonment as provided\n\nfor in subsections B through F of Section 20N of Title 21 of the\n\nOklahoma Statutes, or a fine of not more than Ten Thousand Dollars\n\n($10,000.00), or by both such imprisonment and fine.\n\nC. If a contractor, subcontractor, supplier, subsidiary,\n\nprincipal or affiliate thereof, has been found to have violated this\n\nact and that violation occurred within three (3) years of another\n\nviolation of this act, the Office of Management and Enterprise\n\nServices shall prohibit that contractor, subcontractor, supplier,\n\nsubsidiary, or affiliate thereof, from entering into a state project\n\nor state contract and from further bidding to a state entity, and\n\nfrom being a subcontractor to a contractor for a state entity and\n\nfrom being a supplier to a state entity.","path":["OK Code","Title 74"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os74.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"90645abc4d784a0ac6fae1b15a2f9024f927091acd1b9e739e66902789c968da","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-74-74-85.45g","next":"us-ok/okla.-stat.-tit.-74-74-85.45i"},"notice":"GroundRules: Original legal text.
