Stat. tit. 74, § 74-85.45r","heading":"Requirements of online bidding process – Limitations on","body":"application of act – Disclosure – Remedies.\n\nA. When a state agency determines that online bidding is more\n\nadvantageous than other procurement methods provided by the laws of\n\nthis state, the agency may use online bidding to obtain bids as\n\nauthorized by the Oklahoma Central Purchasing Act or the Public\n\nFacilities Act for purchases or acquisitions as defined in Section\n\n85.2 of this title.\n\nB. The online bidding process shall provide:\n\n1. A designated opening and closing date and time. At the\n\nopening date and time, state agencies shall begin accepting online\n\nbids. Online bids shall be accepted until the designated closing\n\ndate and time, except as provided by paragraph 6 of this subsection;\n\n2. The posting of all online bids electronically and updating\n\nof bids on a real-time basis by state agencies;\n\n3. The authorization for state agencies to require bidders to\n\nregister before the opening date and time and, as part of that\n\nregistration, require bidders to agree to any terms, conditions or\n\nother requirements;\n\n4. The authorization for state agencies to also require\n\npotential bidders to prequalify as bidders and to restrict\n\nsolicitations to prequalified online bidders for bids submitted\n\npursuant to the Public Facilities Act;\n\n5. The retention of the authority of state agencies to\n\ndetermine the criteria that will be used as the basis for making\n\nawards; and\n\n6. The authorization for the State Purchasing Director, under\n\nthe Oklahoma Central Purchasing Act or the State Facilities Director\n\nunder the Public Facilities Act, in the event the state agency\n\ndetermines that a significant error or event occurred that affected\n\nthe electronic receipt of any online bid by the agency, to determine\n\nit is in the best interest of the state to allow the agency to\n\naccept an electronic bid after the specified official closing date\n\nand time.\n\nC. The provisions of the Oklahoma Online Bidding Act shall not\n\napply to bid or proposal sealing or opening provisions found in any\n\nstate law other than the Oklahoma Central Purchasing Act or the\n\nPublic Facilities Act.\n\nD. All bids submitted through the online bidding process\n\npursuant to the Oklahoma Online Bidding Act are subject to the same\n\npublic disclosure laws that govern bids received pursuant to sealed\n\nbid procurement procedures pursuant to the Oklahoma Central\n\nPurchasing Act or the Public Facilities Act.\n\nE.
