Stat. tit. 74, § 74-85.52","heading":"Intent of Legislature - Implementation of act -","body":"Exemptions.\n\nA. It is the intent of the Legislature that all state public\n\nentities comply with the provisions of the Oklahoma State Recycling\n\nand Recycled Materials Procurement Act. All political subdivisions\n\nof this state are encouraged to collect and recycle recoverable\n\nwaste paper and recyclable materials to the greatest extent\n\npossible. The Office of Management and Enterprise Services shall\n\ncoordinate recycling efforts among the state public entities. The\n\nDirector of the Office of Management and Enterprise Services shall\n\nadopt such rules, regulations, and orders as are necessary for the\n\nimplementation of the Oklahoma State Recycling and Recycled\n\nMaterials Procurement Act. The rules and regulations at a minimum\n\nshall establish procedures for:\n\n1. The identification, handling, hauling, storing, safety\n\nfactors, and disposition of recoverable waste paper and recyclable\n\nmaterials;\n\n2. The separation of recoverable waste paper and recyclable\n\nmaterials from solid waste generated by state public entities;\n\n3. A system for the collection of recoverable waste paper and\n\nrecyclable materials from solid waste generated by state public\n\nentities;\n\n4. Assuring that the recoverable waste paper and recyclable\n\nmaterials are made available to private industries for collection\n\nand recycling at the greatest economic value and to the greatest\n\nextent feasible. The Office may execute multiple contracts as\n\nnecessary for purposes including but not limited to serving other\n\ngovernment entities and different geographic areas of the state. In\n\naddition to the preference provisions of Section 85.53 of this\n\ntitle, rules and regulations governing availability of recyclable\n\nmaterials shall give preference to private recyclable materials\n\nindustries that operate in Oklahoma, and that will employ residents\n\nof the state to handle, transport and sort such materials;\n\n5. The purchase of uncoated office paper and printed paper\n\nwhenever practicable; and\n\n6. Separating for the purpose of recycling all recyclable\n\nmaterials including but not limited to lead acid batteries, waste\n\noil and major appliances that are generated as solid waste by state\n\npublic entities.\n\nB. All state public entities shall comply with the procedures\n\nand systems established pursuant to the Oklahoma State Recycling and\n\nRecycled Materials Procurement Act.\n\nC. 1. The Director may exempt any single activity or facility\n\nof any state public entity from compliance with rules promulgated\n\npursuant to the Oklahoma State Recycling and Recycled Materials\n\nProcurement Act if the Director determines there is a lack of market\n\navailability or that it is not economically feasible to follow and\n\ncomply with the procedures and systems established by the Director.\n\n2. The exemption shall be for a period not in excess of one (1)\n\nyear, but additional exemptions may be granted for periods not to\n\nexceed one (1) year.\n\n3.
