Stat. tit. 74, § 74-85.58E","heading":"Risk management insurance coverage - Transportation for","body":"the elderly and handicapped.\n\nA. The Risk Management Administrator, pursuant to the\n\nprovisions of this section and Section 85.34 of Title 74 of the\n\nOklahoma Statutes, may obtain or provide insurance coverage for any\n\nvehicle used by any entity specified in subsection B of this section\n\nfor transportation services for elderly and/or handicapped persons.\n\nThe Risk Management Administrator is authorized to determine\n\neligibility criteria for participation in the Risk Management\n\nProgram by such transportation services. In addition, the Risk\n\nManagement Administrator is authorized to establish equipment and\n\nsafety standards for the vehicles to be covered by the Risk\n\nManagement Program.\n\nB. The Risk Management Administrator may obtain or provide the\n\ninsurance coverage authorized by subsection A of this section for:\n\n1. Counties;\n\n2. Municipalities;\n\n3. Community action agencies designated pursuant to Sections\n\n5035 through 5040 of Title 74 of the Oklahoma Statutes;\n\n4. Any charitable corporation formed for the purpose of\n\nproviding either a volunteer or full-time fire department,\n\nestablished pursuant to Section 592 of Title 18 of the Oklahoma\n\nStatutes, furnishing transportation for elderly and handicapped\n\npersons; and\n\n5. Any vehicle owned and operated by a nonprofit organization\n\nthat pursuant to contract with the state or a political subdivision\n\nof the state provides older persons transportation to and from\n\nmedical, dental and religious services and relief from business and\n\nsocial isolation.\n\nC. The governing authorities of such transportation services\n\nfor elderly and handicapped persons shall be required to make\n\npayments for such insurance coverage as provided by Section 85.37 of\n\nTitle 74 of the Oklahoma Statutes.\n\nD. Requests for the insurance coverage provided pursuant to the\n\nprovisions of this section shall be submitted in writing to the Risk\n\nManagement Administrator by the transportation services for elderly\n\nand handicapped persons specified in subsection B of this section.\n\nThose transportation services for elderly and handicapped persons\n\nmeeting eligibility criteria shall be approved for participation in\n\nthe Risk Management Program by the Risk Management Administrator if\n\nthe vehicles used by transportation services for elderly and\n\nhandicapped persons meet the equipment and safety standards\n\nestablished by the Risk Management Administrator.","path":["OK Code","Title 74"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os74.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"16a5fa5ae4328788ad6246359dde4db41c83719ebead306e4ad74f1bbd007716","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-74-74-85.58d","next":"us-ok/okla.-stat.-tit.-74-74-85.58f"},"notice":"GroundRules: Original legal text.
