Stat. tit. 74, § 74-85.58L","heading":"Risk Management Political Subdivision Participation","body":"Revolving Fund.\n\nA. There is hereby created in the State Treasury a revolving\n\nfund for the Office of Management and Enterprise Services, to be\n\ndesignated the \"Risk Management Political Subdivision Participation\n\nRevolving Fund\". The fund shall be a continuing fund, not subject\n\nto fiscal year limitations, and shall consist of any monies\n\ntransferred thereto by an act of the Legislature and any fees\n\ncollected by the Office of Management and Enterprise Services and\n\ndeposited pursuant to law. All monies accruing to the credit of\n\nsaid fund shall be expended by the Office of Management and\n\nEnterprise Services for the purposes specified by this section and\n\nthe salaries and administrative expenses of support staff\n\nresponsible for administering the fund and expenses the Office\n\nincurs to support program operations. Expenditures from the fund\n\nshall be made upon warrants issued by the State Treasurer against\n\nclaims filed as prescribed by law with the Director of the Office of\n\nManagement and Enterprise Services for approval and payment.\n\nB. Within the Risk Management Political Subdivision\n\nParticipation Revolving Fund, there is hereby created the\n\nConservation District Protection Account. The account shall be set\n\napart as a separate, permanent and perpetual account not subject to\n\nfiscal year limitations and shall consist of:\n\n1. All fees and other monies received pursuant to Section\n\n85.58I of this title; and\n\n2. Interest attributable to investment of monies in the\n\naccount.\n\nC. 1. The monies deposited in the Risk Management Political\n\nSubdivision Participation Revolving Fund shall at no time become\n\nmonies of any other state agency. Except as otherwise authorized by\n\nthis subsection, no monies from the Risk Management Political\n\nSubdivision Participation Revolving Fund shall be transferred for\n\nany purpose to any other state agency or be used for the purpose of\n\ncontracting with any other state agency or reimbursing any other\n\nstate agency for any expense.\n\n2. Monies in the Risk Management Political Subdivision\n\nParticipation Revolving Fund shall only be expended for:\n\na. the purposes specified by this section, and\n\nb. costs incurred by the Comprehensive Professional Risk\n\nManagement Program for the administration of duties\n\nthis section specifies and expenses the Department\n\nincurs to support program operations.\n\nD. Any costs incurred by the Office of Management and\n\nEnterprise Services pursuant to the provisions of this section shall\n\nnot exceed the actual expenditures made by the Office of Management\n\nand Enterprise Services to implement the provisions of this section.\n\nE. Payment of claims from the Risk Management Political\n\nSubdivision Participation Revolving Fund shall not become or be\n\nconstrued to be an obligation of this state.
