Stat. tit. 74, § 74-85.70","heading":"Volunteer firefighters - Volunteer Firefighters Group","body":"Insurance Pool.\n\nA. 1. Except as provided for in subsections E though I of this\n\nsection, volunteer fire departments organized pursuant to state law\n\nmay obtain workers’ compensation insurance for volunteer\n\nfirefighters through the Volunteer Firefighter Group Insurance Pool\n\npursuant to requirements established by CompSource Mutual Insurance\n\nCompany which shall administer the Pool. For the premium set by\n\nCompSource Mutual Insurance Company, the state shall provide Fifty-\n\nfive Dollars ($55.00) per firefighter per year. Except as otherwise\n\nprovided by subsection D of this section, the total amount paid by\n\nthe state shall not exceed Three Hundred Twenty Thousand Three\n\nHundred Thirty-eight Dollars ($320,338.00) per year or so much\n\nthereof as may be necessary to fund the Volunteer Firefighter Group\n\nInsurance Pool.\n\n2. CompSource Mutual Insurance Company shall collect the\n\npremium from state agencies, public trusts, and other\n\ninstrumentalities of the state. Any funds received by CompSource\n\nMutual Insurance Company from any state agency, public trust, or\n\nother instrumentality for purposes of workers’ compensation\n\ninsurance pursuant to this section shall be deposited to the credit\n\nof the Volunteer Firefighter Group Insurance Pool. CompSource\n\nMutual Insurance Company shall collect premiums, pay claims, and\n\nprovide for excess insurance as needed.\n\nB. CompSource Mutual Insurance Company shall electronically\n\nreport, annually, to the Governor, the Speaker of the House of\n\nRepresentatives, and the President Pro Tempore of the Senate the\n\nnumber of enrollees in the Volunteer Firefighter Group Insurance\n\nPool, and the amount of any anticipated surplus or deficiency of the\n\nPool; and shall also provide to the Governor, the Speaker of the\n\nHouse of Representatives and the President Pro Tempore of the Senate\n\nsixty (60) days’ advance notice of any proposed change in rates for\n\nthe Volunteer Firefighter Group Insurance Pool.\n\nC. The amount of claims paid, claim expenses, underwriting\n\nlosses, loss ratio, or any other financial aspect of the Volunteer\n\nFirefighter Group Insurance Pool shall not be considered when\n\ndetermining or considering bids for the amount of any premiums,\n\nrates, or expenses owed by, or any discounts, rebates, dividends, or\n\nother financial benefits owed to any other policyholder of\n\nCompSource Mutual Insurance Company.\n\nD. Except as otherwise provided by law, any increase in the\n\nstate payment rate for volunteer firefighters under the Volunteer\n\nFirefighter Group Insurance Pool shall not exceed five percent (5%)\n\nper annum. Any proposed change in rates for the Volunteer\n\nFirefighter Group Insurance Pool must be approved by the Board of\n\nDirectors of CompSource Mutual Insurance Company with notice\n\nprovided pursuant to subsection B of this section. CompSource\n\nMutual Insurance Company shall not increase premiums for the\n\nVolunteer Firefighter Group Insurance Pool more than once per annum.\n\nE. 1. The provisions of subsections A through D of this\n\nsection shall apply only to workers’ compensation claims for\n\nvolunteer firefighters incurred prior to the effective date of this\n\nact.\n\n2. Not later than the effective date of this act, the Volunteer\n\nFirefighter Group Insurance Pool shall be transferred to the Office\n\nof Management and Enterprise Services Comprehensive Professional\n\nRisk Management Program. Provided, existing reserves from the Pool\n\nshall remain with CompSource Mutual Insurance Company for the\n\npurpose of managing claims incurred prior to the effective date of\n\nthis act. All claims incurred on and after the effective date of\n\nthis act shall be administered by the Office of Management and\n\nEnterprise Services (OMES).\n\n3. OMES may contract with a third-party administrator or hire\n\nnot more than two full-time personnel for the purposes of\n\nadministering the Pool.\ncurred prior to the effective date of\n\nthis act. Nothing in this section shall be construed to permit OMES to\n\nadminister workers’ compensation to a paid fire department as such\n\nterm is defined in Section 29-104.1 of Title 11 of the Oklahoma\n\nStatutes.\n\nF. 1. Volunteer fire departments organized pursuant to state\n\nlaw may obtain workers’ compensation insurance for volunteer\n\nfirefighters through the Volunteer Firefighter Group Insurance Pool\n\npursuant to requirements established by the Office of Management and\n\nEnterprise Services Comprehensive Professional Risk Management\n\nProgram.\n\n2. OMES shall collect a premium of One Hundred Twenty Dollars\n\n($120.00) per firefighter per year from state agencies, public\n\ntrusts, and other instrumentalities of the state. Any funds\n\nreceived by OMES from any state agency, public trust, or other\n\ninstrumentality for purposes of workers’ compensation insurance\n\npursuant to this section shall be deposited to the credit of the\n\nVolunteer Firefighter Group Insurance Pool. OMES shall collect\n\npremiums, pay claims, and provide for excess insurance as needed.\n\nG.
