Stat. tit. 74, § 74-9030.2","heading":"Definitions","body":"As used in the Oklahoma Art in Public Places Act:\n\n1. \"Art\", \"artwork\", or \"work of art\" means all forms of\n\noriginal creations of visual art, except for blasphemous material as\n\ndefined by Section 901 of Title 21 of the Oklahoma Statutes or\n\nindecent or obscene material as defined by Section 1024.1 of Title\n\n21 of the Oklahoma Statutes, including, but not limited to:\n\na. sculpture, in any material or combination of\n\nmaterials, whether in the round, bas-relief, high\n\nrelief, mobile, fountain, kinetic, or electronic,\n\nb. painting, including murals and frescoes,\n\nc. mosaic,\n\nd. photography,\n\ne. fine crafts made from clay, fiber and textiles, wood,\n\nglass, metal, plastics or any other material, or any\n\ncombination thereof,\n\nf. drawing,\n\ng. calligraphy,\n\nh. mixed media composed of any combination of forms or\n\nmedia,\n\ni. unique architectural stylings or embellishments,\n\nincluding architectural crafts,\n\nj. ornamental gateways, and\n\nk. restoration or renovation of existing works of art of\n\nhistorical significance;\n\n2. \"Artist\" means a practitioner in the visual arts committed\n\nto producing high quality work, as recognized by the peers and\n\ncritics of the artist, on a regular basis. The term \"artist\" shall\n\nnot include the architect of a public building under construction or\n\nany member of the architectural firm of the architect;\n\n3. \"Council\" means the Oklahoma Arts Council;\n\n4. \"Division\" means the Art in Public Places Division;\n\n5. \"Maintenance\" means the ongoing upkeep required for artworks\n\nto retain their structural and aesthetic integrity;\n\n6. \"Appointing authority\" shall be the Director or designee of\n\nthe Project Agency;\n\n7. \"Project\" means any capital expenditure, including, but not\n\nlimited to, bond issues, with the purpose of renovating or\n\nconstructing public buildings costing Two Hundred Fifty Thousand\n\nDollars ($250,000.00) or more;\n\n8. \"Project agency\" means institutions within The Oklahoma\n\nState System of Higher Education or the department, board,\n\ncommission, institution, or agency of the state subject to the\n\nOklahoma Art in Public Places Act. The legislative and judicial\n\nbranches of the State of Oklahoma shall be subject to the procedures\n\nof the Oklahoma Art in Public Places Act or shall implement another\n\nprocess to include art in locations subject to the control of those\n\nbranches. Provided, that the expenditure for commissioning art by\n\nthe legislative and judicial branches shall be no less than that\n\nestablished by Section 9030.5 of this title;\n\n9. \"Project architect\" means the person or firm designing the\n\npublic construction project;\n\n10. \"Public construction\" or \"public building\" means any state\n\nbuilding, facility, structure or park constructed, including any\n\nstate-owned lands or space surrounding or integral to the building,\n\nfacility, structure or park. The term \"public construction\" or\n\n\"public building\" shall not include:\n\na. water, sewer, public utility projects, prisons,\n\nprojects with the primary purpose of complying with\n\nthe standards of the Americans with Disabilities Act,\n\nand data processing purchases which are not part of a\n\npublic construction project and any capital projects\n\nundertaken by political subdivisions of the state as\n\ndefined by paragraph 11 of Section 152 of Title 51 of\n\nthe Oklahoma Statutes on buildings or land that they\n\ncontrol, and\n\nb. capital projects subject to federal public art laws.\n\nParticipation in the Oklahoma Art in Public Places Act shall be\n\npermissive for road, highway, turnpike, and bridge construction\n\nprojects of the Department of Transportation and the Oklahoma\n\nTurnpike Authority;\n\n11. \"Public land\" means a site owned by the State of Oklahoma\n\nwith major public access and visibility that serves a business,\n\nsocial, or environmental need; and\n\n12. \"Repair\" means those extraordinary activities required to\nrnpike, and bridge construction\n\nprojects of the Department of Transportation and the Oklahoma\n\nTurnpike Authority;\n\n11. \"Public land\" means a site owned by the State of Oklahoma\n\nwith major public access and visibility that serves a business,\n\nsocial, or environmental need; and\n\n12. \"Repair\" means those extraordinary activities required to\n\nrepair or restore a malfunctioning or damaged work of art.","path":["OK Code","Title 74"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os74.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"5a5ae8e1a23c70d78aa8268dfcade8c1f305d78b2f033a078f1c62bcc347fe31","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-74-74-9030.1","next":"us-ok/okla.-stat.-tit.-74-74-9030.3"},"notice":"GroundRules: Original legal text.
