Stat. tit. 74, § 74-9030.5","heading":"Funding by state agencies - Maximum assessment -","body":"Allocation to Art in Public Places Administrative and Maintenance\n\nRevolving Fund.\n\nA. 1. Except as otherwise provided by subsection C of this\n\nsection, all state agencies, including institutions within The\n\nOklahoma State System of Higher Education, all state departments,\n\nboards, councils, and commissions shall allocate, as a nondeductible\n\nitem out of any expenditures for capital projects including, but not\n\nlimited to, bond issues for state construction excluding costs for\n\nbond issuance and related reserves, an amount of one and one-half\n\npercent (1 1/2%) of the expenditure to the Oklahoma Arts Council for\n\nthe purpose of funding the Oklahoma Art in Public Places Act, except\n\nas otherwise provided by subsection B of this section.\n\n2. The maximum assessment for any project shall not exceed Five\n\nHundred Thousand Dollars ($500,000.00). This assessment shall not\n\napply to any private donations for a capital project. This\n\nallocation shall be applicable to all state agency capital projects\n\napproved by the appointing authority after September 1, 2004. The\n\nworks of art commissioned pursuant to the Oklahoma Art in Public\n\nPlaces Act may be placed on public lands, integral to or attached to\n\na public building or structure, or detached within or outside a\n\npublic building or structure.\n\nB. 1. Of the assessment provided for in subsection A of this\n\nsection, four-fifths (4/5) shall be placed in the Commissioning of\n\nArt in Public Places Revolving Fund, created in Section 9030.6 of\n\nthis title, for the commission of any work of art for the Oklahoma\n\nArt in Public Places Act. Institutions within The Oklahoma State\n\nSystem of Higher Education shall remain in complete administrative\n\ncontrol of their four-fifths (4/5) assessment pursuant to this\n\nsubsection for the acquisition of art. The remaining one-fifth\n\n(1/5) of the assessment shall be reserved for the Art in Public\n\nPlaces Administrative and Maintenance Revolving Fund created by\n\nSection 9030.7 of this title.\n\n2. Monies deposited in the Art in Public Places Administrative\n\nand Maintenance Revolving Fund for the purpose of this moratorium\n\nshall be used for continued administration, educational costs and\n\nmaintenance.\n\nC. The provisions of subsection A of this section shall not be\n\napplicable:\n\n1. For the fiscal years ending:\n\na. June 30, 2012,\n\nb. June 30, 2013, and\n\nc. June 30, 2014; and\n\n2.
