There is hereby created in the State Treasury a fund to be\n\ndesignated the \"Unregulated Utility Consumer Protection Fund\", which\n\nshall be utilized by the Oklahoma Development Finance Authority to\n\nmake loans to unregulated utilities to carry out the purposes of\n\nthis act. The fund shall consist of proceeds from the issuance of\n\nobligations authorized in Section 6 of this act, revenues from the\n\nloan program and any other contributions from unregulated utilities\n\npermitted by law.\n\nB. To the extent the unregulated utility receives, prior to the\n\nissuance of a loan pursuant to this act, insurance proceeds,\n\ngovernmental grants or any other source of funding that compensates\n\nit for extreme purchase costs or extraordinary costs, or if actual\n\namounts are determined to be lower than estimated amounts, those\n\namounts shall be used to reduce the qualified costs of the\n\nunregulated utility that are recoverable from customers. If the\n\namounts are received after the issuance of a loan, they shall be\n\nremitted to the Authority and deposited into the Unregulated Utility\n\nConsumer Protection Fund.
