Stat. tit. 74, § 74-910","heading":"Eligible employers - Procedure for joining System -","body":"Withdrawal.\n\n(1) An eligible employer may join the System in January of any\n\nyear. Application for affiliation shall be in the form of a\n\nresolution approved by the governing or legislative body of the\n\neligible employer or by any other body or officer authorized by the\n\nlaw or recognized by the Board to approve such resolution or action;\n\nprovided, that no county hospital, city or town, circuit engineering\n\ndistrict or any public or private trust in which a county, city or\n\ntown participates and is the primary beneficiary shall become a\n\nparticipating employer except by the adoption of a resolution\n\ntherefor, unless otherwise provided in this act. Upon the filing of\n\na certified copy of such resolution with the Board, the employer\n\nshall become a participating employer on January 1 of the year\n\nimmediately following the filing of such election with the Board.\n\nSuch election shall be final and irrevocable and any employer now or\n\nhereafter participating in the System shall not be permitted to\n\nwithdraw from the System under any circumstances, including a change\n\nin legal identity of such employer, where the purpose and functions\n\nof such employer remain essentially the same as at the time of\n\nfiling of entry into the System. Provided, however, any hospital\n\njoining the System during the period commencing December 1, 1989,\n\nand ending January 31, 1990, or during the period commencing\n\nDecember 1, 1971, and ending January 31, 1972, shall be permitted to\n\nwithdraw from the System by the adoption of resolution therefor by\n\nthe hospital board of control. However, no member hospital of the\n\nSystem shall be allowed to withdraw from the System until such\n\nhospital has satisfied all current obligations to the System. Upon\n\nthe filing of a certified copy of such resolution with the Board and\n\nupon the Board's determining that arrangements have been made for\n\nthe payment of all financial obligations, if any, due the System by\n\nsuch withdrawing hospital, such hospital shall cease to be a\n\nparticipating employer on the first day of the month immediately\n\nfollowing such determination and the filing of such resolution with\n\nthe Board. The employees of any such hospital withdrawing from the\n\nSystem shall have such rights as are provided by Section 912.1 of\n\nthis title. Any hospital that withdraws under the provisions of\n\nthis act shall be responsible for the payment of any actuarial cost\n\nrequired as a result of such withdrawal. Provided, however, any\n\ncounty having a population of less than four hundred thousand\n\n(400,000), according to the latest Federal Decennial Census, shall\n\nbecome a participating employer on January 1, 1974, notwithstanding\n\nany other provision of statute.\n\n(2) The State of Oklahoma, in its capacity as an eligible\n\nemployer shall become a participating employer on the first entry\n\ndate and thereafter on the entry date immediately following the\n\ncreation of any state agency not now in existence.\n\n(3) From and after the passage of this act no county hospital,\n\nor county or state governmental agency, shall institute a retirement\n\nsystem other than as provided for in this act, except as to any\n\nother supplemental retirement plans otherwise expressly provided for\n\nby law.","path":["OK Code","Title 74"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os74.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"a5056c4e54e35998194377c302f944c3178f6d665072e4c7a1962207956ab6b2","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-74-74-909.2","next":"us-ok/okla.-stat.-tit.-74-74-910.1"},"notice":"GroundRules: Original legal text.
