The Department of Public Safety shall establish and maintain\n\na Mental Wellness Division to provide mental wellness services and\n\nprograms to public safety personnel and retirees thereof to promote\n\ngood mental wellness. The Commissioner of Public Safety shall\n\nappoint the Director of the Mental Wellness Division.\n\nB. The Director of the Mental Wellness Division shall report to\n\nthe Commissioner. All current and former employees of the Mental\n\nWellness Division shall maintain the privacy of all public safety\n\npersonnel served by the Division or who participate in its programs.\n\nNo privileged personal health information shall ever be shared with\n\nthe Commissioner or made public without the consent of that person.\n\nHowever, aggregate mental health information may be shared with the\n\nCommissioner. Aggregate mental health information may be made\n\npublic by the Commissioner if, in the judgment of the Commissioner,\n\ndoing so could improve public safety mental wellness policies for\n\npublic safety personnel and the information is made public for this\n\nsole purpose. Provided, no aggregate mental health information may\n\nbe shared or made public if doing so could reveal otherwise\n\nprivileged personal mental health information about any specific\n\nindividual. It shall be the duty of the Director of the Division to\n\nestablish the necessary policies and procedures to ensure the\n\nprivacy and confidentiality requirements of this section and of all\n\nother applicable health privacy laws. Any breach of the privacy\n\nprovisions of this section and of any other applicable health\n\nprivacy laws must be timely and thoroughly investigated and the\n\nappropriate disciplinary and corrective actions taken.\n\nC. The Mental Wellness Division is authorized to enter into\n\npartnerships with private entities to fulfill its mandate.\n\nD.
