Stat. tit. 74, § 74-916.3v1","heading":"Pension benefit on behalf of correctional, probation","body":"and parole officers killed in the line of duty - Dependent children\n\nand education.\n\nA. 1. Notwithstanding the provisions of Sections 901 through\n\n932 of this title, a monthly pension, as provided in subsection B of\n\nthis section, shall be paid on behalf of any member who is a\n\ncorrectional officer or probation and parole officer of the\n\nDepartment of Corrections and who is killed or mortally wounded on\n\nor after January 1, 2000, during the performance of the member's\n\nduties for the Department or any employee of the Department of\n\nCorrections who is killed or mortally wounded after June 30, 2004,\n\nduring the performance of the member's duties for the Department.\n\n2. The monthly pension described in this section shall be paid\n\non behalf of any member first hired by any county that is a\n\nparticipating employer in the System as a deputy sheriff or jailer\n\non or after November 1, 2020, and who is killed or mortally wounded\n\nduring the performance of the member's duties as a deputy sheriff or\n\njailer.\n\n3. The monthly pension described in this section shall be paid\n\non behalf of a licensed emergency medical personnel hired by any\n\nparticipating employer for the first time as a licensed emergency\n\nmedical personnel on or after the effective date of this act, and\n\nwho is killed or mortally wounded during the performance of the\n\nmember's duties as an emergency medical personnel.\n\nB. The monthly benefit shall be equal to:\n\n1. Two and one-half percent (2 1/2%);\n\n2. Multiplied by twenty (20) years of service, regardless of\n\nthe actual number of years of credited service performed by the\n\nmember prior to death, if the member had performed less than twenty\n\n(20) years of credited service, or the actual number of years of\n\ncredited service of the member if greater than twenty (20) years;\n\n3. Multiplied by the member's final average compensation; and\n\n4. Divided by 12.\n\nC. The pension provided for in subsection A of this section\n\nshall be paid:\n\n1. Except as provided in subsection D of this section, to the\n\nsurviving spouse for life; or\n\n2. If there is no surviving spouse or upon the death of the\n\nsurviving spouse:\n\na. to the surviving child or children of said member or\n\nlegal guardian of such child or children for such time\n\nas such child or children are under the age of\n\neighteen (18) years, or\n\nb. to the surviving child or children between the age of\n\neighteen (18) and twenty-two (22) years if the child\n\nis enrolled full time in and is regularly attending a\n\npublic or private school or any institution of higher\n\neducation.\n\nD. No surviving spouse shall receive benefits from this\n\nsection, Section 49-113 of Title 11 of the Oklahoma Statutes,\n\nSection 50-117 of Title 11 of the Oklahoma Statutes, or Section 2-\n\n306 of Title 47 of the Oklahoma Statutes as the surviving spouse of\n\nmore than one member of the Oklahoma Firefighters Pension and\n\nRetirement System, the Oklahoma Police Pension and Retirement\n\nSystem, the Oklahoma Law Enforcement Retirement System, or the\n\nOklahoma Public Employees Retirement System. The surviving spouse\n\nof more than one member shall elect which member's benefits he or\n\nshe will receive.\n\nE. In addition to the pension above provided for, if said\n\nmember leaves one or more children under the age of eighteen (18)\n\nyears or under the age of twenty-two (22) years if the child is\n\nenrolled full-time in and is regularly attending a public or private\n\nschool or any institution of higher education, Four Hundred Dollars\n\n($400.00) a month shall be paid to the surviving spouse or to the\n\nperson having the care and custody of such children if there is no\n\nsurviving spouse or if the surviving spouse dies and until each\n\nchild reaches the age of eighteen (18) years or reaches the age of\n\ntwenty-two (22) years if the child is enrolled full-time in and is\n\nregularly attending a public or private school or any institution of\n\nhigher education.\nbe paid to the surviving spouse or to the\n\nperson having the care and custody of such children if there is no\n\nsurviving spouse or if the surviving spouse dies and until each\n\nchild reaches the age of eighteen (18) years or reaches the age of\n\ntwenty-two (22) years if the child is enrolled full-time in and is\n\nregularly attending a public or private school or any institution of\n\nhigher education.\n\nF. The pension benefit provided in this section shall be made\n\nprospectively only from July 1, 2000. The benefits shall be payable\n\nbeginning the later of the first day of the month following the date\n\nthat such employee was killed or dies from a mortal wound, as\n\nprovided in this section, or July 1, 2000.\n\nG.
