There is hereby created, until June 30, 2028, the Broadband\n\nExpansion Council. Effective June 30, 2028, the Council shall\n\nterminate. The Council shall utilize the year prior to the\n\ntermination date for the purpose of ceasing the Council's affairs.\n\nB. The Council shall consist of fourteen (14) persons to be\n\nselected as follows:\n\n1. Three members shall be appointed by the Governor, one of\n\nwhom shall be the individual serving as the Executive Director of\n\nthe Oklahoma Broadband Office, one of whom shall be a current or\n\npast mayor of a municipality having a population of less than\n\nthirty-five thousand (35,000) persons according to the latest\n\nFederal Decennial Census or most recent population estimate and\n\nwhich is not part of either the Oklahoma City or Tulsa Metropolitan\n\nStatistical Areas, and one of whom shall be a resident of this state\n\nand a wireless Internet service provider (WISP);\n\n2. Five members shall be appointed by the Speaker of the\n\nOklahoma House of Representatives, one of whom shall represent the\n\ninterests of rural Internet service providers, one of whom shall be\n\na private sector technology professional with expertise in broadband\n\nconnectivity, access, price and related economic factors, one of\n\nwhom shall represent the interests of rural health care, one of whom\n\nshall be a representative of a wireless telecommunications provider\n\nnot affiliated with an incumbent local exchange carrier in Oklahoma\n\nand one who shall be a representative of a wireless\n\ntelecommunications provider with operations in Oklahoma and at least\n\ntwenty-four other states;\n\n3. Five members shall be appointed by the President Pro Tempore\n\nof the Oklahoma State Senate, one of whom shall be a professional\n\nhaving academic expertise in large-scale information technology\n\ninfrastructure with emphasis on rural broadband access, one of whom\n\nshall represent the interests of rural business enterprises, one of\n\nwhom shall be a citizen from a community of less than fifty thousand\n\n(50,000) persons which is not part of either the Oklahoma City or\n\nTulsa Metropolitan Statistical Areas, one of whom shall be a rural\n\nelectric cooperative representative and one who shall be an Oklahoma\n\nresident and Tribal Leader of a tribe recognized in this state; and\n\n4. One nonvoting member to be selected by the Oklahoma\n\nCorporation Commission who has expertise in administration of the\n\nUniversal Service Fund, but who is not an elected member of the\n\nCommission.\n\nC. A quorum of the membership of the Council shall be necessary\n\nin order to take any final action pursuant to the provisions of this\n\nact.\n\nD. The Council shall be subject to the Oklahoma Open Meeting\n\nAct and the Oklahoma Open Records Act.\n\nE. The Council shall serve as the advisory board to the\n\nOklahoma Broadband Office.\n\nF. The Council shall advise the Office in developing and\n\ncontinually monitoring the Office's Plan related to:\n\n1. Identifying geographic areas to be utilized in developing\n\nthe Office's policies for establishing or improving broadband access\n\nin the state pursuant to the Oklahoma Broadband Expansion Act;\n\n2. Assessing the financial viability of broadband service\n\nproviders so that a broadband network is adequately supported in its\n\noperations, that needed repairs and upgrades can be undertaken on a\n\ntimely basis and that the goal of having a quality long-term\n\nbroadband service delivery system across the state is achieved and\n\nmaintained;\n\n3. Maintaining the viability of the Oklahoma Universal Service\n\nFund and give consideration to whether similar universal funds\n\nshould be implemented in order to facilitate broadband expansion and\n\noperational costs for underserved areas; and\n\n4. Preventing duplication of facilities and investment when the\n\nOffice makes grant recommendations. With the input of the Council,\n\nthe Oklahoma Broadband Office shall establish objective standards in\nUniversal Service\n\nFund and give consideration to whether similar universal funds\n\nshould be implemented in order to facilitate broadband expansion and\n\noperational costs for underserved areas; and\n\n4. Preventing duplication of facilities and investment when the\n\nOffice makes grant recommendations. With the input of the Council,\n\nthe Oklahoma Broadband Office shall establish objective standards in\n\norder to determine whether the construction of broadband access\n\nconstitutes duplication of facilities and investment and also the\n\nrole of any recommended incentives that would benefit entities in\n\nthe private sector so that public resources are effectively utilized\n\nand that duplication of efforts is avoided.\n\nG.
