Stat. tit. 75, § 75-11a","heading":"Construction of statutes - Severability","body":"In the construction of the statutes of this state, the following\n\nrules shall be observed:\n\n1. For any act enacted on or after July 1, 1989, unless there\n\nis a provision in the act that the act or any portion thereof or the\n\napplication of the act shall not be severable, the provisions of\n\nevery act or application of the act shall be severable. If any\n\nprovision or application of the act is found to be unconstitutional\n\nand void, the remaining provisions or applications of the act shall\n\nremain valid, unless the court finds:\n\na. the valid provisions or application of the act are so\n\nessentially and inseparably connected with, and so\n\ndependent upon, the void provisions that the court\n\ncannot presume the Legislature would have enacted the\n\nremaining valid provisions without the void one; or\n\nb. the remaining valid provisions or applications of the\n\nact, standing alone, are incomplete and are incapable\n\nof being executed in accordance with the legislative\n\nintent.\n\n2.
