Article V of the Oklahoma Constitution vests in the\n\nLegislature the power to make laws, and thereby to establish\n\nagencies and to designate agency functions, budgets and purposes.\n\nArticle VI of the Oklahoma Constitution charges the Executive Branch\n\nof Government with the responsibility to implement all measures\n\nenacted by the Legislature.\n\nB. In creating agencies and designating their functions and\n\npurposes, the Legislature may delegate rulemaking authority to\n\nexecutive branch agencies to facilitate administration of\n\nlegislative policy. The delegation of rulemaking authority is\n\nintended to eliminate the necessity of establishing every\n\nadministrative aspect of general public policy by legislation. In\n\nso doing, however, the Legislature reserves to itself:\n\n1. The right to retract any delegation of rulemaking authority\n\nunless otherwise precluded by the Oklahoma Constitution;\n\n2. The right to establish any aspect of general policy by\n\nlegislation, notwithstanding any delegation of rulemaking authority;\n\n3. The right and responsibility to designate the method for\n\nrule promulgation, review, repeal and modification;\n\n4. The right to approve or disapprove or repeal any adopted\n\nrule by joint resolution; and\n\n5.
