The Secretary of State shall provide for the\n\ncodification, compilation, and publication of agency rules and\n\nExecutive Orders in a publication which shall be known as the\n\n\"Oklahoma Administrative Code\" in the following manner:\n\na. On or before January 1, 1992, the Secretary shall\n\ncompile Executive Orders which are effective pursuant\n\nto paragraph 3 of subsection B of this section, and\n\nagency rules which have been submitted pursuant to the\n\nagency schedule of compliance and have been accepted\n\nas properly codified, as set forth in this section,\n\nand rules promulgated by the Secretary. Such\n\ncompilation shall be maintained by the Office of\n\nAdministrative Rules and shall be updated by agencies,\n\nin a manner prescribed by the Secretary, to reflect\n\nsubsequent permanent rulemaking. Prior to publication\n\nof the first \"Code\", as set forth in subparagraph b of\n\nthis paragraph, the compilation shall constitute the\n\nofficial permanent rules of the state. Effective\n\nJanuary 1, 1992, any permanent rule not included in\n\nsuch compilation shall be void and of no effect.\n\nb. On or before December 1, 1992, the Secretary shall\n\nhave published the \"Oklahoma Administrative Code\". To\n\neffectuate this provision, the Secretary may contract\n\nfor the publishing of the \"Oklahoma Administrative\n\nCode\". Any permanent rule not published in the \"Code\"\n\nshall be void and of no effect. A finally adopted\n\nrule filed and published in \"The Oklahoma Register\"\n\nmay be valid until publication of the next succeeding\n\n\"Code\" or \"Code\" supplement following the date of its\n\nfinal adoption. Provided, a permanent rule which is\n\nfinally adopted after the closing date for publication\n\nin a \"Code\" or \"Code\" supplement as announced by the\n\nSecretary may be valid until publication of the next\n\nsucceeding \"Code\" or \"Code\" supplement. A permanent\n\nrule which is published in \"The Oklahoma Register\"\n\nafter the closing date for publication in the first\n\n\"Code\", as announced by the Secretary, shall be void\n\nand of no effect upon publication of the next\n\nsucceeding \"Code\" or \"Code\" supplement, if not\n\npublished in the \"Code\" or \"Code\" supplement.\n\n2. Compilations or revisions of the \"Code\" or any part thereof\n\nshall be supplemented or revised annually. The \"Code\" shall be\n\norganized by state agency and shall be arranged and printed in a\n\nmanner to permit separate publications of portions thereof relating\n\nto individual agencies.\n\n3. Annual supplements to the \"Code\" shall be cumulative.\n\nEmergency rules shall not be published in the \"Code\" or in any\n\nsupplements thereto.\n\n4. \"The Oklahoma Register\" shall also include a sections-\n\naffected index of the \"Code\". The \"Code\" and supplements shall\n\ncontain such notes, cross-references and explanatory materials as\n\nrequired by the Secretary.\n\n5. The Secretary in preparing such rules for publication in the\n\n\"Code\" or supplements shall omit all material shown in canceled\n\ntype. The Secretary shall not prepare any rule for publication in\n\nthe \"Code\" which amends or revises a rule unless the rule so\n\namending or revising conforms to the provisions of the\n\nAdministrative Procedures Act.\n\n6. The Secretary is authorized to determine a numbering system\n\nand other standardized format for documents to be filed and may\n\nrefuse to accept for publication any document that does not\n\nsubstantially conform to the promulgated rules of the Secretary.\n\nB. 1. Rules submitted and accepted for publication in the\n\n\"Code\" by August 15 of each year shall be published in the next\n\nsucceeding \"Code\" or supplement thereto.\n\n2. As soon as possible after August 15 of each year, the\n\nSecretary shall assemble all rules and Executive Orders, except\n\nemergency rules, promulgated after the publication of the preceding\n\n\"Code\" or \"Code\" supplement in accordance with the provisions of the\naccepted for publication in the\n\n\"Code\" by August 15 of each year shall be published in the next\n\nsucceeding \"Code\" or supplement thereto.\n\n2. As soon as possible after August 15 of each year, the\n\nSecretary shall assemble all rules and Executive Orders, except\n\nemergency rules, promulgated after the publication of the preceding\n\n\"Code\" or \"Code\" supplement in accordance with the provisions of the\n\nAdministrative Procedures Act for publication in the \"Oklahoma\n\nAdministrative Code\". The \"Code\" or supplements thereto should be\n\npublished as soon as possible after August 30 of each year.\n\n3. Executive Orders of previous gubernatorial administrations\n\nshall terminate ninety (90) calendar days following the inauguration\n\nof the next Governor unless otherwise terminated or continued during\n\nthat time by Executive Order. Copies of all Executive Orders shall\n\nbe published in the \"Oklahoma Administrative Code\". All Executive\n\nOrders placing agencies or employees under the State Merit System of\n\nPersonnel Administration shall remain in effect unless otherwise\n\nmodified by action of the Legislature.\n\nC. The Secretary is hereby authorized and empowered to publish\n\nor to contract to publish the \"Oklahoma Administrative Code\", and to\n\npublish or contract to publish such annual cumulative supplements so\n\nas to keep the \"Code\" current. All such agreements shall provide\n\nthat the publisher shall make such publications in such form and\n\narrangement as shall be approved by the Secretary. The Secretary\n\nmay publish or authorize the publication of the \"Code\" in part.\n\nD. The Secretary is authorized to correct spelling errors in\n\nrules submitted for publication in the \"Code\" or any such\n\nsupplements or in \"The Oklahoma Register\". Any other errors in\n\nrules submitted for publication in the \"Code\" may be noted in\n\neditorial notes provided by the Secretary.\n\nE. The Secretary shall make copies of the \"Code\" generally\n\navailable at a cost sufficient to defray the cost of publication and\n\nmailing. Except as otherwise provided by Section 257.1 of this\n\ntitle, the Secretary is authorized to sell or otherwise distribute\n\nthe \"Code\" and its supplements.\n\nF. 1. The codification system, derivations, cross-references,\n\nnotes of decisions, source notes, authority notes, numerical lists,\n\nand codification guides, other than the actual text of rules,\n\nindexes, tables and other aids relevant to the publication of the\n\n\"Oklahoma Administrative Code\" and \"The Oklahoma Register\" shall be\n\nthe property of the state and may be reproduced only with the\n\nwritten consent of the Secretary. The information which appears on\n\nthe same page with the text of a rule may be reproduced incidentally\n\nwith the reproduction of the rule, if the reproduction is for the\n\nprivate use of the individual and not for resale. No person shall\n\nattempt to copyright or publish the \"Oklahoma Administrative Code\"\n\nor \"The Oklahoma Register\", in printed or electronic media, without\n\nexpressed written consent of the Secretary of State. The Secretary\n\nshall notify the Speaker of the Oklahoma House of Representatives\n\nand the President Pro Tempore of the Oklahoma State Senate of any\n\nrequests to copyright or publish the \"Oklahoma Administrative Code\"\n\nor \"The Oklahoma Register\", prior to consent by the Secretary.\n\n2. The Secretary shall provide for the electronic access to the\n\n\"Oklahoma Administrative Code\" and \"The Oklahoma Register\" by:\n\na. Internet access at no charge, or\n\nb. an exclusive or a nonexclusive contract for public and\n\nprivate access.\n\n3. Publications of rules by agencies are not official\n\npublications.\n\n4.
