Stat. tit. 75, § 75-308v1","heading":"Review of proposed rules by Legislature - Approval or","body":"disapproval.\n\nA. Upon receipt of any proposed permanent rules, the Speaker of\n\nthe House of Representatives and the President Pro Tempore of the\n\nSenate shall assign such rules to the appropriate committees of each\n\nhouse of the Legislature for review. Except as otherwise provided\n\nby this section:\n\n1. If such rules are received on or before February 1, the\n\nLegislature shall have until the last day of the regular legislative\n\nsession of that year to review such rules; and\n\n2. If such rules are received after the date established\n\npursuant to paragraph 1 of this subsection, the Legislature shall\n\nhave until the last day of the regular legislative session of the\n\nnext year to act on such rules.\n\nB. By the adoption of joint resolutions during the review\n\nperiod specified in subsection A of this section, the Legislature\n\nmay disapprove or approve any rule and disapprove all or part of a\n\nrule or rules.\n\nC. Unless otherwise authorized by the Legislature, whenever a\n\nrule is disapproved as provided in subsection B of this section, the\n\nagency adopting such rules shall not have authority to resubmit an\n\nidentical rule, except during the first sixty (60) calendar days of\n\nthe next regular legislative session. Any effective emergency rule\n\nwhich would have been superseded by a disapproved permanent rule\n\nshall be deemed null and void on the date the Legislature\n\ndisapproves the permanent rule. Rules may be disapproved in part or\n\nin whole by the Legislature. Upon enactment of any joint resolution\n\ndisapproving a rule, the agency shall file notice of such\n\nlegislative disapproval with the Secretary of State for publication\n\nin “The Oklahoma Register”.\n\nD. Unless otherwise provided by specific vote of the\n\nLegislature, joint resolutions introduced for purposes of\n\ndisapproving or approving a rule or the omnibus joint resolution\n\nshall not be subject to regular legislative cutoff dates, shall be\n\nlimited to such provisions as may be necessary for disapproval or\n\napproval of a rule, and any such other direction or mandate\n\nregarding the rule deemed necessary by the Legislature. The\n\nresolution shall contain no other provisions.\n\nE. A proposed permanent rule shall be deemed finally adopted\n\nif:\n\n1. Approved by the Legislature pursuant to Section 308.3 of\n\nthis title, provided that any such joint resolution becomes law in\n\naccordance with Section 11 of Article VI of the Oklahoma\n\nConstitution;\n\n2. Approved by a joint resolution pursuant to subsection B of\n\nthis section, provided that any such resolution becomes law in\n\naccordance with Section 11 of Article VI of the Oklahoma\n\nConstitution; or\n\n3. Disapproved by a joint resolution pursuant to subsection B\n\nof this section or Section 308.3 of this title which has been vetoed\n\nby the Governor in accordance with Section 11 of Article VI of the\n\nOklahoma Constitution and the veto has not been overridden.\n\nProvided, major rules shall be addressed in one or more joint\n\nresolutions only addressing major rules, regardless of if the joint\n\nresolution is to approve or disapprove such rules.\n\nF. Prior to final adoption of a rule, an agency may withdraw a\n\nrule from legislative review. Notice of such withdrawal shall be\n\ngiven to the Governor, the Speaker of the House of Representatives,\n\nthe President Pro Tempore of the Senate, and to the Secretary of\n\nState for publication in “The Oklahoma Register”.\n\nG. An agency may promulgate an emergency rule only pursuant to\n\nSection 253 of this title.\n\nH.
